You can use AI coding tools without giving them every unreleased detail of your game, but no single legal measure protects everything. In the United States, copyright can protect original expression fixed in a tangible form—such as qualifying code, writing, art, and music—not the broad premise, mechanic, system, or method of play. To reduce disclosure risk, document your human-created work, limit access to confidential material, and check the specific tool, feature, account plan, and settings before sharing project context.
What can copyright protect in a game?
U.S. copyright law distinguishes a game’s expressive material from the ideas and systems behind it. An original work may qualify for copyright when it is fixed in a tangible form; the U.S. Copyright Office identifies computer programs and pictorial or audiovisual works among the kinds of works copyright can cover. That can include qualifying code, art, music, dialogue, lore, and written pitch material.

Copyright does not grant ownership of the general idea expressed by those materials. The Copyright Office says it does not protect “ideas, concepts, systems, or methods of doing something,” and its games guidance says that a game idea, title, and methods for playing are not protected by copyright. A distinctive written description or illustration may contain protectable expression, but that does not make the underlying game concept exclusive.

Can I copyright a game idea?
No—not the abstract idea itself. Copyright may protect the original way you have written, drawn, composed, or coded something, but it does not make the general premise or method of play yours to exclude others from using.
For example, a short description of a game can contain original wording, and character illustrations can contain original visual expression. Those elements are distinct from the high-level concept they communicate. Someone else might create a game with a similar broad premise without copying the protected expression in your pitch or art. This distinction is why a copyright claim over a written pitch should not be treated as a way to reserve the gameplay idea described in it.

Keep that boundary in mind when deciding what to share with an AI assistant. A prompt that gives away the defining mechanic may disclose commercially sensitive know-how even if copyright would not protect that mechanic as an idea. A prompt that includes an original dialogue scene, artwork, or code also sends expressive material. Those are different concerns: one is about the limits of copyright; the other is about confidentiality and the tool’s handling of what you submit.
Which game assets should I document?
Keep dated records of the material your team creates and the changes people make to it. Documentation does not turn an unprotected idea into copyrighted expression, but it can help you identify the work, preserve its development history, and show where people contributed expressive choices.

Make a record for each kind of work
- Code: Keep the project’s source-control history, including commits that show substantial human-written or human-edited work. Note when AI assistance was used if that helps explain how a particular passage or feature developed.
- Writing: Retain drafts of pitches, dialogue, lore, character descriptions, and rules text. Preserve meaningful revisions rather than only the final export.
- Art and audio: Keep original working files and dated versions of illustrations, UI assets, music, and sound-related material. Record substantial human selection, revision, or arrangement of AI-assisted material.
- Team contributions: Track who created or revised each significant asset. For commissioned contributions, use written agreements that establish who owns the work; do not assume that a file being delivered to the project answers that question.
- AI-assisted work: Preserve relevant drafts and examples of the human decisions made after generation, such as revisions, selection among alternatives, creative arrangement, and integration into the game.
Make the records useful rather than ceremonial: connect a date and contributor to a specific version or change. A commit, dated working file, and short note about a substantial human edit can make the history more legible than a folder containing only a final build.
Does using AI remove copyright protection from my work?
Not automatically. The U.S. Copyright Office’s January 29, 2025 announcement summarizing Part 2 of its AI report says generative AI output can be protected only where a human author has determined sufficient expressive elements. The question is what human authorship is present in the work, not simply whether an AI tool touched the workflow.
The Office says that merely providing prompts is not enough to establish human authorship of generated output. Human-authored material, creative arrangement, or modification may matter. A developer who writes substantial code, revises generated passages, selects and combines elements creatively, or integrates material through expressive decisions should preserve evidence of those contributions. The presence of AI in the workflow alone does not establish that the resulting work is either protected or unprotected.
Keep separate records for what the tool generated and what a person contributed. For example, retain the prompt and output when relevant, then preserve the edits, selections, and arrangement that shaped the final work. Do not treat a prompt log by itself as proof that a person authored the generated expression. The Copyright Office has developing guidance on AI and registration; check its current materials when preparing a registration rather than assuming a general rule settles a particular work.

Can unreleased game material qualify as a trade secret?
Potentially, if the information derives value from being secret and the owner makes reasonable efforts to preserve that secrecy. This is a separate question from copyright: trade secret treatment concerns confidential information and secrecy measures, not exclusive ownership of a broad game idea through copyright.
Valuable unreleased code, designs, production plans, or data may be candidates for secrecy-based protection, but calling something confidential is not a substitute for protecting it in practice. Limit access to people who need it, separate sensitive files from material meant to be public, and use confidentiality terms where appropriate. Do not assume that putting a label on a pitch or keeping it in a private repository is enough to answer every legal question about secrecy.
The cited discussion of the trade-secret rule comes from American Intellectual Property Law Association comments hosted by the USPTO. It is stakeholder commentary, not a USPTO ruling. Whether specific game information qualifies, and whether a team’s steps are reasonable, depends on the facts; consult a U.S. lawyer for advice about a commercially important secret.
What should I check before sharing work with an AI coding tool?
Check how the exact product, feature, and account handles the data it receives, then send only the context needed for the task. A tool’s brand or a repository’s privacy setting alone does not answer what happens to prompts, code snippets, outputs, or associated context submitted to an assistant.

- Classify the material. Decide whether the task requires public or generic code, ordinary project context, or a core secret such as an unreleased mechanic, proprietary source, character or plot details, asset files, credentials, or private repository content. Treat the last group as sensitive until you have checked the applicable terms and controls.
- Identify the exact feature and account. Check whether you are using an IDE assistant, CLI, chat, extension, connected repository feature, or a third-party model. The handling may differ by feature, selected model, account tier, or organization agreement.
- Read the current data terms and settings. Look for whether inputs, outputs, snippets, and context are retained; how long they are retained; whether data can be used for training or product improvement; and whether an opt-out exists and is enabled. Do not infer an answer to retention from a statement about training, or the reverse.
- Check connected context. Find out what files or repository information the feature can include, whether context is selected automatically, and whether you can exclude specific files. Avoid providing a full project when a small, generic example will solve the coding problem.
- Check organizational terms. If a team account or company agreement applies, verify which people and features it covers and whether subprocessors or third-party models are involved. Do not assume a company’s terms automatically apply when a developer switches to a personal account or separate feature.
- Minimize the prompt. Remove secrets and unnecessary details. Replace a proprietary class or story element with a small representative example when the tool can answer without the real material.
- Recheck after changes. Review the policy and settings again when the vendor changes its terms, your plan changes, or you enable a new feature. A previous decision applies only to the terms and workflow you checked at that time.
For material central to the game’s commercial value, keep it out of prompts and connected context unless the contractual and technical controls are adequate for your risk tolerance. If you cannot establish what a feature sends or how it is handled, the conservative choice is not to submit the sensitive material.

Training and retention are different questions. The cited policy information addresses training use, but does not establish a retention period for every prompt, output, or context item. Likewise, the fact that a repository is private does not by itself show how material sent to an assistant is processed. Check the handling of the feature you use rather than treating repository privacy as an answer to tool-data questions.

How can a small team build a lower-disclosure workflow?
Use AI assistance where the task can be separated from the game’s most sensitive information. A team can often ask for help with a generic programming issue without disclosing its setting, characters, unreleased mechanics, or proprietary implementation.
Before the tool is used
- Decide which project materials are public, ordinary internal material, or restricted confidential information.
- Keep credentials and other access secrets out of prompts and source files supplied as context.
- Review the vendor terms and feature settings for the account each person will actually use, not just the account the team lead uses.
- Agree on who may enable repository connections, extensions, or alternate models, and how the team will review changes to those choices.
While solving a coding problem
- Describe the technical behavior with a small, generic example when the real source code is not necessary.
- Share only the relevant code or files rather than giving a feature broad access to the project by default.
- Do not paste unreleased plot, character designs, asset files, or defining mechanics simply to make a prompt more vivid.
- Review generated code and content before integrating it; retain the human edits and decisions that materially shape the final result.
Afterward
- Keep the human-authored and edited project history in the normal development record.
- Note when sensitive material was intentionally shared and which terms and settings were checked, so the team can revisit the decision if the policy changes.
- Remove or revoke unnecessary connections when the task no longer requires them, using the product’s available controls.
This workflow does not guarantee confidentiality or resolve ownership questions. Its purpose is to reduce unnecessary disclosure, preserve a clear record of human contributions, and make tool use a deliberate decision rather than an automatic consequence of connecting a project.
How should I decide whether to use a tool on a particular task?
Match the task to both the sensitivity of its inputs and the protections you have verified. If the task needs only a generic explanation or a small non-sensitive code example, disclosure is lower than when it requires a full repository, unreleased source, proprietary assets, or a central mechanic.

The practical principle is simple: protect expression through documentation and appropriate ownership arrangements, protect secrets through actual access and disclosure controls, and evaluate AI use against the exact data terms in force for the feature and account.

Can I copyright a game title in the United States?
The Copyright Office’s games guidance says a title is not protected by copyright. This is separate from other legal questions about names or branding, which are outside the copyright discussion here.
Does an NDA make my game concept exclusive?
