Is Generative AI in Games Trained on Copyrighted Work?

Sometimes, but there is no industry-wide yes or no. Game-related AI systems can be trained on creator uploads, company-owned material, licensed commercial datasets, open-license or public-domain repositories, synthetic data, or combinations of those sources. Roblox says some creator content from users who have not opted out may enter training data and warns that material can carry third-party intellectual-property rights. KRAFTON, by contrast, says its inZOI systems used selected images, 3D models and motion data that it considered commercially permitted or company-owned. Those disclosures describe particular systems, not every game model. Whether a copyrighted work appeared in training is also a different question from whether that use infringed copyright under the law of a particular country.

Is generative AI in games trained on copyrighted work?

It can be. The answer depends on the named model, its task, the developer, the data sources and the jurisdiction. “AI in games” is not one model or one universal corpus: a texture generator, coding assistant, character-image model and motion generator may each have separate training pipelines.

Copyright status and infringement are separate questions. A dataset may contain a copyright-protected work, yet the legal treatment of copying it for training can depend on permission, license terms, exceptions, fair-use or text-and-data-mining rules, and facts such as how the model was built and used. Conversely, a developer’s statement that it selected commercially permitted material is evidence of its stated approach, not an independent audit of every underlying file.

The most accurate formulation is therefore specific: identify what the developer says a particular system used, what rights basis it claims, what controls creators have, and what the applicable law says. The available public disclosures do not provide a complete, independently verified inventory of training works for the games industry.

Why does the model and task matter?

Training data is assembled for a purpose. A system that generates code may use text and code; a texture tool may use images and annotations; a motion model may use filmed movement or skeletal data. Treating all of these as one “game AI dataset” hides important differences.

Different tasks can have different datasets

  • Image and texture generation: visual files, captions, tags, ratings and preference data can be combined to teach visual patterns.
  • Code assistance: source code, documentation and natural-language examples may be used, subject to the provider’s stated sources and licenses.
  • 3D asset generation: meshes, materials and metadata are distinct from ordinary photographs.
  • Motion generation: video, pose tracks or motion-capture samples can be collected and labeled separately from visual artwork.

Even within one game, a studio can use an external model for one feature and a proprietary model for another. A storefront notice that says a game contains AI-assisted development or live generation identifies use of AI, not necessarily the full training corpus behind it.

What does Roblox say about its training data?

Roblox’s Creator Hub documentation says its public generative-AI tools include Code Assist, Material Generator, Assistant, Texture Generator and Avatar Setup. It states that source categories vary by system and can include publicly accessible permissively licensed or public-domain repositories, non-public data obtained from third-party providers through commercial arrangements, platform activity and creator material where users have not opted out, internally generated and synthetic data, and material from annotation services and contractors. Roblox’s wording is: “Roblox’s generative AI systems made available to the public are trained on the following, with particular data sources varying for each system.”

The same documentation warns that training data may include material subject to third-party intellectual-property rights. It lists possible text and audio text, visual content, annotations, ratings and preference data. Depending on the system type and version, Roblox says training can involve over 3 million distinct assets; that is a maximum-range statement, not a count for every model. The company says these data are used to improve its tools and generation in language and virtual 3D environments. See the Roblox AI data-sharing documentation for the current wording.

What are Roblox creators’ sharing defaults?

Roblox’s controls are date-sensitive and apply to the platform’s stated categories. For games, avatar items and paid assets published before July 10, 2024, sharing is off by default. For those published on or after that date, sharing is on by default unless the creator changes the setting.

Roblox says that when a creator stops sharing, it removes the content from the training dataset within 30 days and updates models trained using that data within 365 days. These are Roblox’s published timelines, not a general standard for other platforms. They also do not prove that a particular output was generated from one identifiable asset, or that every historical copy has disappeared from every intermediate system.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What does that disclosure prove?

It establishes that Roblox may use some creator data under its stated settings and acknowledges possible third-party rights. It does not identify every work in every model, confirm ownership or license scope item by item, or constitute an independent audit. The careful conclusion is that some Roblox training data may include creator material that is copyright-protected or otherwise subject to third-party rights—not that all Roblox models were trained on unauthorized work.

What does KRAFTON say about inZOI’s AI systems?

In a notice dated May 13, 2025, KRAFTON described three inZOI technologies separately. The company says these are its own system descriptions, not an outside verification.

Model or task Stated training material Rights basis described by KRAFTON What the statement does not establish
Text-to-image (T2I) 20 million publicly available images Images selected under Creative Commons licenses that KRAFTON says permit commercial use and modification It does not independently verify every image, license notice or downstream restriction.
3D-printing AI Approximately 46,000 high-quality 3D models Models KRAFTON owned or sourced from datasets it says were permitted for commercial use It does not provide a public, work-by-work inventory in the notice.
Video-to-motion Over 1.7 million motion-data samples Primarily data KRAFTON says it owned and collected, supplemented by a limited number of publicly available open-license datasets The notice does not resolve every license or jurisdictional issue for each supplement.

KRAFTON’s exact description of the image system is that it “was trained using publicly available images that are permitted for commercial use.” The inZOI notice illustrates why a model-by-model question is more useful than a claim about “game AI” in general: the image, 3D and motion systems had different stated sources and rights rationales.

Does using copyrighted material for training automatically mean infringement?

No. Copyrighted, licensed and infringing are not interchangeable labels. A work can be copyright-protected but used under a license; it can be copied in a context where a legal exception is argued; or it can be used without permission in a way a rightsholder challenges. The outcome depends on the country, the relevant statute or case law, the source, the copying process and the model’s use.

Why jurisdiction changes the answer

The UK government’s Report on Copyright and Artificial Intelligence, published March 18, 2026, says generative-AI models are often trained on creative works protected by copyright and that public disclosure by developers is limited. It describes different national approaches and notes that the UK does not generally require AI developers to publicly disclose the copyright works used to develop a model. The report also describes European Union AI Act duties for providers of general-purpose AI models to publish sufficiently detailed summaries of training material. Those are region-specific policy points, not a worldwide rule.

In the United States, the Copyright Office’s AI study includes a May 9, 2025 pre-publication Part 3 report addressing generative-AI training. Its AI study index is the official place to identify the multipart work and later updates. The Office received more than 10,000 comments by the December 2023 deadline, showing the breadth of the policy debate, not a final answer for every model.

Why output copyright is a separate issue

The Copyright Office’s January 29, 2025 Part 2 announcement concerns whether an output can receive copyright protection. It says AI assistance or AI-generated material inside a larger human-generated work does not automatically bar copyrightability when a human author determines sufficient expressive elements. That conclusion addresses authorship of the output; it does not decide whether training copies were licensed or lawful. The announcement is available at Copyright Office Releases Part 2 of Artificial Intelligence Report.

What can a Steam AI disclosure tell you about training?

Valve’s Steam developer policy distinguishes AI-assisted material made during development from content generated live at runtime. A disclosure can therefore tell players that a studio used AI in production or that a feature generates content while the game runs. It does not automatically list the model’s training works, identify every dataset provider, or prove that the training material was licensed or unlicensed.

Industry commentary adds context but is not an audit. Video Games Europe’s April 2024 position paper distinguishes earlier machine-learning uses of company-owned telemetry or game data from generative systems trained on creative assets, where copyright questions become more prominent. Treat that as an industry association’s position rather than evidence about every studio.

How can you investigate what a particular game’s AI was trained on?

Use a source-specific checklist instead of inferring provenance from the game’s store page or from the look of an output.

  1. Name the feature and model task. Record whether the claim concerns code, images, textures, 3D meshes, dialogue, music or motion. A developer may disclose one system while leaving another undescribed.
  2. Find a first-party statement. Check the developer’s privacy, AI-use, terms or technical documentation and note its publication date. Preserve the exact wording because defaults and datasets can change.
  3. Classify the stated sources. Separate creator uploads, company-owned works, third-party commercial arrangements, open-license or public-domain repositories, synthetic data and annotation services. “Publicly available” does not by itself mean “public domain.”
  4. Check the rights basis. Look for a named license, commercial-use permission, ownership statement or opt-out mechanism. A broad claim that data was “licensed” may not reveal whether the license covered model training, modification, redistribution or every item in a collection.
  5. Check creator controls and dates. Record whether sharing was opt-in or opt-out, when the setting changed, and what deletion or model-update period the provider promises.
  6. Separate evidence from inference. A distinctive output, a Steam label or a policy statement cannot identify a specific training work without additional documentation. Mark what is disclosed, what is unknown and what is disputed.
  7. Apply the relevant law. If a dispute concerns a particular work, country and use, consult qualified legal advice. The legality of training cannot be determined from the word “copyrighted” alone.

What should players, modders and creators take from these disclosures?

  • Players: an AI label is mainly a transparency signal about how content was made or generated, not a guarantee about dataset provenance.
  • Creators uploading assets: read the platform’s data-sharing setting and its effective date before publishing. Keep your own source files, licenses and publication records so you can show authorship or permission later.
  • Modders and studios: document which model produced an asset, the prompt or input material, the provider’s terms and any human editing. That record helps distinguish a licensed workflow from an unverified assumption.
  • Rightsholders: preserve the allegedly matching work, dates, model or feature name and screenshots or files showing the output. A similarity claim alone does not reveal the training corpus, so provenance evidence matters.

What is the practical answer for the games industry?

Some game AI is trained on data that may include copyrighted works, including creator material, while other developers describe systems built from owned or commercially permitted sources. Public disclosures are uneven: Roblox provides categories and creator-control timelines, whereas KRAFTON gives model-specific quantities and stated rights bases for inZOI. Neither disclosure is an independent, item-by-item audit, and neither can stand in for a legal decision about every training use.

Frequently Asked Questions

Can a developer prove that its game AI is copyright-safe?

A developer can publish dataset categories, licenses, contracts and audit procedures, but a public summary rarely proves the status of every underlying work. The strongest evidence is model-specific documentation with traceable sources and a process for handling disputed items; even then, a court or regulator may apply different rules in a particular jurisdiction.

Are open-license images automatically safe for AI training?

No. An open license may permit some uses but require attribution, preserve share-alike terms or exclude commercial activity, database rights or identifiable-person restrictions. The license attached to the original file also may not cover every derivative, metadata field or later redistribution.

What should I do if an AI-generated game asset appears to copy my work?

Save the original work, registration or publication records, the allegedly similar output and the game version or date. Use the developer’s rights or takedown channel and request information about the feature and provider; obtain legal advice before making a formal infringement claim because similarity alone does not establish how the model was trained.

Does human editing make an AI-generated game asset copyrightable?

In the United States, the Copyright Office says AI assistance or AI-generated material in a larger human-made work does not automatically prevent protection when a human determines sufficient expressive elements. The amount and kind of human control matter, and this authorship question is separate from whether training material was lawfully copied.
