Usually, an occasional non-commercial fan trailer recorded in offline GTA V single-player is the lowest-risk approach. Use a legitimate copy, keep every mod and tool away from GTA Online, avoid leaks and major spoilers, and clear music and other imported assets. That approach fits the limited tolerance described in Rockstar’s public fan-content policy, but it is not a blanket licence and Rockstar can still request removal.
A monetized, commissioned or professionally distributed trailer is different. Rockstar’s policy excludes film, television, streaming distribution, music videos, advertising and publishing, so obtain written licensing guidance before releasing work in those categories.

Risk level depends on how you make and distribute the trailer
There is no single yes-or-no answer because four variables change the exposure: whether the video is commercial, which game mode you use, where every asset came from, and how much story material you reveal.

“Lower risk” does not mean guaranteed legality, immunity from a takedown, or permission to redistribute a mod itself. Copyright, contract, trademark and publicity rules can also vary by country, so a commercial project may require advice from a qualified lawyer.

What Rockstar’s fan-content policy actually says
Its tolerance is aimed at occasional, non-commercial fan work
Rockstar’s policy on posting copyrighted Rockstar Games material, last updated January 10, 2025, says: “Generally, Take-Two Interactive does not object to our fans using materials for non-commercial uses in a manner which does not intentionally spoil the plot for others.” The same policy welcomes gameplay, machinima and clips. That wording describes a limited tolerance, not a transfer of copyright or a permanent licence.
The policy is framed for individual fans making occasional in-game content. It does not promise that every video will remain online, and it does not override the game’s terms or the rights of other creators. Rockstar reserves the ability to assess a video and request removal case by case.
Content that can trigger removal
- Leaked or pre-release footage.
- Isolated cinematics, endings or major story reveals.
- Isolated in-game television, comedy or other entertainment segments.
- Content that encourages cheating, including third-party mod menus for GTA Online or Red Dead Online.
- Promotion or distribution of unauthorized mods or ports.
A trailer can therefore use a modified environment or a staged camera sequence while still becoming risky if its selling point is a leaked scene, an ending, or a download for an unauthorized port. If story material is essential, put it in a broader narrated or contextual sequence rather than presenting a standalone reveal.

Rockstar says the policy does not apply to film, television, streaming distribution, music videos, advertisements, or books, magazines and digital publishing. A professional trailer, a client commission, a paid campaign or a submission intended for formal distribution should be treated as a licensing question, not as an ordinary fan upload. Rockstar directs filmmakers, producers and production companies to send detailed requests to [email protected].

Why the game’s terms still matter
The in-game licence is revocable and non-commercial
Take-Two’s Terms describe the Services and Content as licensed, not sold, and grant a revocable, personal, non-commercial licence. They restrict unauthorized copying, modification, derivative works, commercialization and other exploitation unless Take-Two gives separate written permission. Rockstar’s public tolerance can reduce practical risk for qualifying fan videos, but it does not erase those contractual limits.
You are responsible for material you add
The Terms require user material not to infringe another party’s copyright, trademark or other intellectual-property rights. A trailer can contain several independent rights layers:
- Game footage and characters supplied by Rockstar.
- The mod itself and any restrictions imposed by its creator.
- Music, sound effects, voices, photographs, maps, models or textures imported from elsewhere.
- Brand names, logos, vehicles, likenesses or other protected elements appearing in the scene.
Keeping the gameplay offline does not give you permission to copy an outside model, use a performer’s voice, or place a commercial song under the edit. Save the licence, permission or source record for every non-Rockstar asset, and remove anything whose provenance you cannot verify.
How to record mods without putting an online account at risk
The safest technical boundary is a clean separation between offline filming and connected play. Rockstar’s May 20, 2024 support guidance warns that online modding, exploit promotion, protected-data manipulation and interference with other players can lead to suspensions or bans.

- Start with a legitimate PC copy. Install the game through an authorised store and keep your account credentials private.
- Create an offline filming setup. Use a separate mod profile or installation where practical, and launch only single-player. Do not allow mod loaders, script hooks or trainers to attach to GTA Online.
- Choose presentation-focused modifications. Camera controls, weather, lighting, vehicles used as set dressing and environment changes are easier to explain as machinima than cheats that alter competitive play.
- Disconnect before testing. If a tool, launcher or script is designed for online use, remove it from the filming workflow. Never test an unfamiliar menu while connected to a Rockstar service.
- Capture and edit offline. Record the scene, close the game, and edit the footage in a separate application. Do not show a mod menu, exploit method or protected-data manipulation in the finished trailer.
- Restore a clean game before going online. Disable or remove modifications, verify the installation if necessary, and only then launch a connected service.
This separation lowers account risk; it cannot guarantee that a particular unauthorized modification complies with the Terms. Read the mod creator’s licence and do not redistribute the files merely because you used them in a video.
Design the trailer to avoid predictable takedown problems
Use original staging instead of restricted story material
Build shots around your own blocking, camera movement, lighting and editing. Avoid a direct recording of a finale, an unedited cutscene, a leaked mission, or a sequence whose only purpose is to reveal a surprise. A short contextual excerpt inside your own narrated scene is less exposed than an isolated cinematic, but it is still wise to minimise plot information.
Do not turn the trailer into a mod advertisement
Showing a visual effect as part of your story is different from promoting or distributing an unauthorized mod or port. Do not include download instructions, links, installation packages or claims that imply official approval. Identify the video as unofficial fan work and avoid logos, wording or thumbnails that suggest Rockstar sponsorship or affiliation.
Audit every external asset before picture lock
- Confirm that music is cleared for the intended platform and commercial status.
- Check whether a model, texture, map or vehicle was imported from another game or creator.
- Obtain permission for photographs, recorded voices, performances and likenesses.
- Review visible brands and logos; blur or replace them when you lack the relevant rights.
- Keep written permissions, invoices, licence terms and the original source files with the project.
GTA V radio music: YouTube tolerance is not a full music licence
Rockstar’s April 3, 2024 Rockstar Editor guidance says GTAV radio tracks included in Rockstar Editor videos can be used on YouTube without a channel copyright strike. It also warns that labels or artists may monetize those videos or restrict viewing in some countries. In other words, avoiding a channel strike does not prevent a rights-holder claim, advertising revenue being redirected, or regional blocking.

For a trailer you control, the most predictable choices are a track you licensed for the exact use and territory, or the instrumental score suggested in Rockstar’s guidance. Keep the licence paperwork and confirm whether it covers monetization, paid promotion, trailers and edits. If a platform identifies the recording, follow the platform’s claim process rather than assuming the Rockstar Editor guidance overrides the music owner’s rights.

Monetized YouTube uploads
Advertising revenue, sponsorship, paid placement and a commissioned deliverable all move the project away from the non-commercial situation described by Rockstar’s fan policy. A disclaimer saying “fan-made” does not turn a paid video into a non-commercial one. Before enabling monetization, ask for written guidance and make sure every added asset is cleared for commercial use.
Film, streaming, advertising and publishing
A trailer supplied to a client, broadcaster, streaming service, festival, publisher or advertising campaign falls within the categories Rockstar says its fan policy does not cover. Send a detailed request to [email protected] describing the footage, modifications, territory, platform, duration, monetization and release schedule. Wait for a written response before relying on the game footage in the final deliverable.

- Classify the release. Mark it private and non-commercial, monetized, commissioned or professionally distributed.
- Map the footage. Record where each shot was captured, which mod was active, and whether the shot contains a cinematic, spoiler or in-game entertainment segment.
- Separate online from offline files. Remove online mod menus, cheats, exploits and scripts from the filming environment.
- Clear the asset list. Obtain written permission or replace every external song, model, logo, photograph, voice and map.
- Review the cut for restricted material. Remove leaks, endings, major reveals, isolated cinematics and instructions for unauthorized mods or ports.
- Check the audio mix. Use cleared music or an appropriate instrumental score, and understand possible claims or country restrictions.
- Package it honestly. Label the upload unofficial, avoid implied affiliation, and do not attach download links for unauthorized modifications.
- Escalate commercial projects. Send the licensing request before release and retain the correspondence with the project records.
What to do after a claim, removal request or account action
YouTube claim or regional block
Identify whether the notice concerns music, footage or another asset. Check your licence, accept the claim when the rights-holder is entitled to monetize or restrict the work, or use the platform’s dispute process only when you can document a valid basis. Replacing the track is often faster than repeatedly re-uploading the same disputed edit.

Rockstar removal request
Do not immediately repost an identical cut on another channel. Preserve the original project, source footage, mod licence and permissions, then remove or revise the material identified in the notice. For a commercial or professional release, ask for written licensing guidance instead of relying on the fan-policy tolerance.
Suspension or ban related to online activity
Stop using the mod or tool on connected services, secure the account and follow Rockstar’s support appeal or review process. Do not publish exploit instructions or attempt to evade an enforcement action with another account. Offline single-player capture is the safer production boundary, but no filming workflow can reverse an action already taken for online interference.
Bottom line for creators
An occasional, non-commercial GTA V machinima trailer made from offline single-player footage, with cosmetic or staging mods and fully cleared audio, is the most defensible form of fan video under Rockstar’s January 10, 2025 policy. The policy remains discretionary and excludes professional distribution. Keep online services mod-free, avoid leaks and major spoilers, clear every third-party asset, and obtain written licensing guidance before monetizing, commissioning or formally distributing the trailer.
