Nintendo of America Inc. filed a lawsuit in the U.S. Court of International Trade on March 6, 2026, seeking refunds of duties it says it paid under tariffs imposed through Trump administration executive orders invoking the International Emergency Economic Powers Act (IEEPA). The complaint requests repayment with interest; it does not show that Nintendo has received a refund.
What Nintendo is suing over
The case, Nintendo of America Inc. v. United States of America et al., is docketed as 1:26-cv-01540 in the U.S. Court of International Trade. The defendants include the United States and several federal departments and agencies, including the Treasury, Homeland Security, Commerce, the Office of the U.S. Trade Representative and Customs and Border Protection.

Nintendo’s complaint alleges that the company imported goods from countries affected by the IEEPA tariffs and paid duties on those imports. It argues that the duties imposed through the executive orders were unlawful and asks the court for relief that includes a prompt refund of duties paid, plus interest. Those are claims and requests in Nintendo’s filing, not findings that the court has made or proof that any money has been returned.

How the Supreme Court ruling fits in
Nintendo’s complaint says the Supreme Court issued its decision in Learning Resources, Inc. v. Trump on February 20, 2026, affirming the lower-court ruling and striking down the IEEPA duties. The complaint also says the presidential order ending tariff collection took effect on February 24. Nintendo filed its case on March 6, after that timeline described in its filing.

What the latest visible court entry says
The latest entry shown in the reviewed Justia docket listing is a July 22, 2026 order. It directs CBP to reliquidate certain entries—recalculate the final duties on imports that had already been processed—where the entries had been liquidated for more than 80 days and Nintendo had made estimated IEEPA-duty deposits. The order makes this relief subject to specified importer-identification and CAPE-declaration conditions.
The order does not grant a blanket refund of all duties Nintendo says it paid. It also states that the case remains stayed except for the actions specifically directed by the order. The docket listing cautions that it may not include later activity, so July 22 is the latest status visible in that listing, not a verified account of the case as of October 2026.
