The terms provide a 30-day window to opt out after first becoming subject to the agreement—but a later terms update does not necessarily restart that window for someone who already accepted an earlier arbitration agreement.
That is the context behind players’ warnings about agreeing to the updated terms. A New York judge did order arbitration in one account-ban case, but the decision turned on that case’s facts; it does not decide every player’s rights or determine whether a particular player can still opt out.
What Pokémon GO’s current arbitration terms say
The current agreement identifies the operator as Scopely Explore, Inc., formerly Niantic, Inc. It says covered disputes relating to its services, sites, products, or terms will generally go to binding arbitration for users in the United States and other jurisdictions that permit arbitration. The terms say this arbitration notice does not apply in the European Economic Area, the United Kingdom, or countries that prohibit the agreement. Read the current Terms of Service for the full language and applicable provisions.
The terms’ Section 13 notice says that, unless a user opts out within 30 days, the user will pursue disputes individually rather than as a plaintiff or class member in a class or representative action, and will waive the right to pursue covered claims in court or have a jury trial. That is the agreement’s stated effect; it is not a determination that every provision will be enforceable in every circumstance.

What the terms say is excluded or handled differently
The agreement describes several exceptions and procedures. These are provisions in the terms, not a guarantee about how a court would resolve a particular dispute.
- Small claims: An individual may bring an eligible claim in small-claims court.
- Specified intellectual-property relief: The terms preserve specified court relief for intellectual-property matters.
- Intentional or willful misuse or abuse: The terms separately reserve court action for intentional or willful misuse or abuse.
- Informal resolution first: The terms call for good-faith informal dispute resolution before arbitration or a small-claims action.
How the 30-day opt-out works under the terms
The current terms say an individual can opt out by emailing [email protected] within 30 days after first becoming subject to the arbitration agreement. The notice must include the sender’s name and address, the account email if applicable, and an unequivocal statement that the sender is opting out. The terms say the rest of the agreement continues to apply after an opt-out.

The deadline is tied to when a player first became subject to the relevant agreement—not automatically to the date they most recently saw an in-game notice. The terms state that if a player already accepted an earlier arbitration agreement and did not validly opt out, a later change does not create a fresh opt-out opportunity for that earlier agreement. They also say rejecting a change leaves the previously applicable arbitration provisions in force, while valid prior opt-outs continue to be honored.
Accordingly, a player’s position may depend on which version they accepted, when they accepted it, whether they sent a valid notice within the applicable period, and where they are located. The public terms and court record cannot establish any individual player’s acceptance or notice history.

What the New York account-ban case decided
In Cardenas v. Niantic, a New York Supreme Court judge granted Niantic’s motion to compel arbitration in a dispute involving a banned account. The decision records that Niantic updated its terms on July 17, 2024, and that Pokémon GO displayed a blocker card requiring users to accept or decline before continuing. The notice reproduced in the decision said: “We’ve updated our Terms of Service, including our arbitration provision. Please review and accept before continuing.” Jerel Cárdenas accepted the updated terms on July 19, 2024, later alleged his account was banned, and brought claims.
The judge’s decision noted that Cárdenas did not allege a timely opt-out and did not dispute that he accepted the terms. The ruling applied the arbitration clause to the record in that particular case. It is not a blanket ruling that every player is bound, that every dispute must be arbitrated, or that a player’s opt-out rights are identical to Cárdenas’s.

What players should check before deciding what the warning means
- Which version of the terms you accepted and the date of acceptance.
- Whether your jurisdiction is covered by the arbitration clause or falls within an exclusion stated in the terms.
- Whether you sent an unequivocal opt-out within the relevant 30-day period, and whether you can confirm when and what you sent.
- Whether the dispute falls within one of the agreement’s stated exceptions.
- Whether you are asking about the general terms or a specific dispute, which may turn on facts not resolved by the cited case.
A player discussion has framed the issue as “Why you should opt out of the new private arbitration agreement.” That is one community member’s characterization, not legal advice and not proof that every player still has a new opt-out opportunity.
