The European Commission responded on 16 June 2026: it said it cannot currently propose a legal requirement to keep games playable after commercial provision ends, while committing to start discussions on an industry end-of-life code by the end of 2026.
What the initiative achieved
The formal initiative, called Stop Destroying Videogames, is part of the broader Stop Killing Games campaign. After Member States verified the signatures, organisers submitted it to the European Commission on 26 January 2026 with 1,294,188 verified statements of support. It exceeded the one-million threshold and met the required national minimums in 24 Member States. The Commission’s procedural account records those results.
The organisers asked the Commission to require publishers selling or licensing games in the EU to leave them in a functional state, rather than remotely disabling them when commercial support ends. The aim is for players to retain the ability to play after a publisher stops providing a game commercially.
Did Stop Killing Games pass?
It passed the signature and verification stage; it did not pass into law. A European Citizens’ Initiative is a way to invite the Commission to consider proposing EU legislation. An initiative that reaches one million signatures from at least seven EU countries must be assessed and receive an official response, but the process does not compel the Commission to adopt the organisers’ proposal. What did the Commission decide?
In its Communication adopted on 16 June 2026, the Commission said: “The Commission considers that at this stage it cannot propose a legal obligation to keep video games playable after they stop being provided commercially.” It cited existing intellectual-property rights, including copyright and rights that may protect visual and technological aspects of games. The Communication sets out the Commission’s position.
That is a refusal to propose the specific binding playability requirement at this stage, not a claim that the initiative failed procedurally or that no further action will follow. The Commission has instead committed to other work:
- By the end of 2026, it plans to begin an exchange with the video game industry and consumer representatives aimed at developing an industry code of conduct for managing games’ end of life.
- It plans to work with consumer organisations and authorities to raise awareness of applicable consumer rights, and to report on application of the Directive on digital content and digital services before the end of 2026.
These are future commitments. The Commission has not announced an adopted code, and the cited response does not establish who will participate, what the final text will say, or what outcome the discussions will produce. Its announcement of the planned engagement describes the intended next steps.
What protection do players have now?
The Commission says EU consumer rules already provide safeguards. Before a consumer signs up for a game, providers must give information about contract duration and termination conditions. The Directive on digital content and digital services also provides remedies when digital content or a service fails to conform to the contract and to what consumers could reasonably expect.

That is not an automatic refund guarantee whenever a game becomes unavailable: the contract and the facts of the individual case matter. The Commission’s consumer-rights announcement outlines these protections.
The Commission argues that actively enforcing existing rights can encourage providers to offer longer game lifespans and explore ways to meet consumer expectations. That is its policy position, not evidence that enforcement has already changed publisher practices.

What to watch next
The campaign’s next policy test is whether the planned discussions lead to a meaningful end-of-life standard—and how that standard compares with the legal obligation organisers requested. A code of conduct and a binding EU-wide rule are not the same: the Commission has committed to pursuing the former discussion, but has not proposed the latter. The year-end consumer-rights report may also clarify how existing protections are being applied, but its findings and any resulting action are not yet established.
