On Oct. 8, 2026, Vice President JD Vance accused Microsoft of replacing U.S. workers with foreign employees and announced that the company and several other firms were being suspended from a program used in the employment-based green-card process. Hours later, President Donald Trump presented Microsoft CEO Satya Nadella with the National Medal of Technology and Innovation. The two events happened on the same day, but the medal presentation did not resolve or address the allegation.
What did the U.S. government accuse Microsoft of?
Vance said Microsoft had laid off American workers while using foreign-worker programs. He described the workers as “what is effectively foreign indentured servants” and said, “You cannot lay off American workers and then replace them with foreign indentured servants.” Those are Vance’s characterizations of the company’s conduct, not a neutral legal description or an adjudicated finding.
According to the Associated Press, Vance announced that Microsoft and several other companies were being suspended from a program used by foreign workers seeking green cards. The materials available about the announcement do not include a formal suspension order or a Microsoft-specific agency notice. The legal authority, duration, precise scope, process for challenging the action and evidence behind it therefore remain unclear.
What figures did Vance cite, and what do they show?
In the announcement, Vance compared 6,000 U.S. layoffs with 6,300 H-1B visas and nearly 3,000 green cards, figures reported by the Associated Press. The available accounts do not establish that these totals describe the same people, jobs or time period. They cannot, by themselves, show that each visa or green card was used to replace a laid-off U.S. worker.

The measures are different, too: layoffs count job losses; H-1B applications are requests concerning temporary work status; approved beneficiaries count people whose petitions were approved; and green-card processes concern permanent residence. Comparing aggregate figures does not identify an individual replacement hire.
How did Microsoft respond to the H-1B allegation?
Microsoft said it filed approximately 6,000 H-1B applications in the prior fiscal year. The company told the Associated Press that 80% were to extend or change the status of people already working at Microsoft, and that the rest were for people already legally in the United States. “These were not to hire new people,” the company said of the extension and status-change filings.

That response contests the implication that the applications represented new workers arriving from abroad, but it does not independently reconcile the government’s cited layoff, visa and green-card figures. An application is not necessarily an approval, and an extension or status change is not the same thing as recruiting a new employee.
Why did Trump give Nadella a medal that day?
Trump presented Nadella with the National Medal of Technology and Innovation hours after Vance’s announcement, according to the Associated Press. Trump praised Nadella’s role in Microsoft’s transformation, saying he had been a key figure in the company for more than three decades and had helped empower businesses, students and consumers with software.

Trump did not address the hiring allegation during the presentation, AP reported. The award recognized Nadella’s contributions to technology; the timing created a sharp contrast with the administration’s announcement, but the presentation itself did not explain or decide the suspension.
What H-1B policy context preceded the announcement?
A Sept. 18, 2026 executive order called for interagency coordination in administering the H-1B program. It directed officials to consider whether an employer had laid off, or planned to lay off, similarly situated U.S. workers when processing H-1B applications and related matters. The order stated the administration’s policy rationale; it is not evidence that Microsoft specifically engaged in the conduct it described.

The White House order also asserted that some employers displace U.S. workers and cited an estimated wage gap of $9,000 to $20,000 in H-1B-reliant industries, as well as 800,000 to 1.3 million technology-sector layoffs from 2022 through 2026. Those are figures asserted by the administration in the order, not independently established universal estimates in the materials available here.

2025 Senate inquiry
In a Sept. 24, 2025 letter, Senators Charles Grassley and Richard Durbin questioned Nadella about Microsoft’s H-1B hiring amid layoffs, including recruitment, possible displacement, wages, contractors and direct employment. The senators cited 5,189 approved H-1B beneficiaries for Microsoft in fiscal year 2025 and called the company the third-largest employer of newly approved beneficiaries. That was a figure and characterization in the senators’ letter; the letter was an inquiry, not a finding that Microsoft had displaced workers.

2021 Justice Department settlement
In 2021, the Justice Department settled claims that Microsoft had requested unnecessary or different immigration documents from some non-U.S. citizens and lawful permanent residents during hiring and work-authorization reverification. DOJ described the matter as citizenship-status discrimination and improper documentary practices. It is a separate issue from the 2026 allegation that Microsoft replaced U.S. workers with H-1B employees.
