Check two things separately: whether you can legally work in the United States when the job starts, and whether the employer will support an employment-visa process now or later. A posting that says “must be authorized to work in the U.S.” does not, by itself, answer the sponsorship question. That distinction matters for applicants with temporary work permission, including people whose authorization may expire or depend on a particular job.
Read the posting for both answers, then ask the recruiter to confirm the policy for the exact role, worksite, and employment type. Do not send a Form I-9 or specific identity documents with your application.

What is the difference between work authorization and visa sponsorship?
Work authorization is your legal ability to work in the United States. Sponsorship is an employer’s willingness to support an employment-based visa process. They are related, but they are not interchangeable: someone may be authorized to work now and still need an employer’s help later.
Federal law requires employers to verify a new employee’s identity and employment authorization through Form I-9 after hire, according to USCIS’s 2023 Form I-9 Employee Information Sheet. Separately, the U.S. Department of Justice’s Immigrant and Employee Rights Section (IER) says employers may generally ask applicants whether they have the legal right to work in the United States and whether they will need sponsorship for an employment visa.

For a video-game studio, publisher, vendor, or other employer, the job title does not resolve either question. A production, engineering, art, QA, or operations opening can have a policy specific to that role, worksite, contract, or customer. Confirm the actual terms rather than inferring them from the company or the position.
Use a two-part check each time you review an opening. First, identify whether you must already be authorized to work when employment begins. Second, identify whether the company will support an employment-visa process if you need one now or later. A “yes” to the first question does not imply a “yes” to the second. Likewise, a company’s willingness to consider sponsorship does not establish that you can begin work on the proposed date.
How should I read common work-authorization and sponsorship phrases?
Look for separate statements about eligibility to work and the employer’s willingness to sponsor. If a sentence addresses only one, do not treat it as an answer to the other.
| Posting phrase | What it generally tells you | What remains unclear |
|---|---|---|
| “Must be authorized to work in the U.S.” | The employer expects you to have work authorization when employment begins. | Whether the employer will sponsor you now or in the future. This wording alone does not answer that. |
| “No sponsorship available” or “We do not sponsor now or in the future” | The employer signals that it does not intend to support an employment-visa case for the role. | Whether the rule covers every visa category, extensions, or a particular worksite or employment arrangement. Ask for the scope if it affects your plans. |
| “Will you now or in the future require sponsorship?” | The employer is asking whether you need employer support now or might need it later. | How the employer handles your current authorization type or a future change in status. Answer accurately, then ask about its policy if the form does not explain it. |
| “Sponsorship considered” or “will sponsor” | The wording suggests sponsorship may be possible. | Which visa category, role, timing, eligibility conditions, and approval process the employer supports. It is not a guarantee that a case will be filed or approved. |
| “U.S. citizens only” or “must be a U.S. person” | The employer is imposing a citizenship- or status-related restriction. | The legal basis and exact scope of the restriction. DOJ best practices say such requirements should be consistent with an applicable legal requirement and should not incorrectly exclude citizenship statuses. |
| “E-Verify required” | The employer uses E-Verify, which complements Form I-9. | Whether the employer sponsors visas. E-Verify use is not an answer to that question. |
Pay attention to where the wording appears. A posting, an application checkbox, a careers-page policy, and a recruiter’s message may not describe the same level of detail. Note the exact phrase and whether it refers to the company generally or to the particular opening. If the application asks whether you will need sponsorship now or in the future, do not assume it is asking only whether you need a petition on your first day.
How can I tell whether my current authorization is enough?
Start with the job’s expected start date and your own authorization, not with a general label such as “international student” or “EAD holder.” Determine whether your authorization will be valid for the work and timing involved; then separately determine whether you will need employer sponsorship later. If you are unsure how your individual authorization applies, do not guess on an application—ask the appropriate qualified adviser about your situation.
If you have OPT, STEM OPT, CPT, or an EAD
These terms do not tell an employer’s sponsorship policy, and their presence on an application does not settle whether a particular person is authorized for a particular job. Ask whether the employer accepts your authorization type for this role, whether any role or worksite restriction applies, and whether it will consider sponsorship before that authorization ends. The recruiter may distinguish between being eligible to start and being eligible for employer support later.
When asked whether you will need sponsorship “now or in the future,” answer based on your circumstances and the wording of the question. A person who can work under current temporary authorization may still need employer support at a later point. Do not answer “no” merely because you can begin work without a new employer petition, and do not answer “yes” as a substitute for clarifying what the employer means if the form is ambiguous.

If an application offers only yes/no choices and you are uncertain how the employer defines sponsorship, avoid treating the checkbox as a substitute for clarification. Give an accurate response based on your circumstances, and ask the recruiter what the question means for the specific role. Keep the discussion focused on the employer’s policy and your ability to meet the stated start-date requirement; the posting itself may not explain how a current authorization type is treated.
If you already have another employer’s visa sponsorship
Do not assume that a new employer’s willingness to consider sponsorship means it will handle a transfer or any other specific filing. Ask whether the company supports the relevant category and situation for this position, and what conditions or timing apply. The posting may not give those details.
What questions should I send the recruiter?
Ask distinct, neutral questions so the answers do not blur current eligibility with future sponsorship. You can adapt this message:

Does this role require me to have U.S. work authorization on the start date? Will the company sponsor an employment visa for this position now or in the future? If sponsorship is available, which categories do you support, such as H-1B or permanent residence, and under what conditions? Does the policy differ for OPT/STEM OPT, an EAD, or a transfer from another employer? Is the requirement tied to this job, worksite, contract, or customer?”
Replace the role title with the posting’s exact title. If a question does not apply to you, omit it; if the recruiter answers generally, ask them to confirm how the answer applies to this particular opening. Save the response in writing along with a copy of the posting.
A useful clarification should make the boundary of the policy clear. For example, ask whether “no sponsorship” applies to all employment-based visa categories, whether it includes future extensions, and whether it is limited to a particular worksite, contract, or customer. If the company does sponsor, ask what category it supports and whether it considers cases at hire or only under specified conditions. These questions help distinguish a broad statement from a role-specific commitment without assuming the recruiter can guarantee an outcome.
What does employer sponsorship involve?
“Sponsorship” can refer to different employment-based processes, so ask what the employer actually supports rather than relying on the word alone. The process and requirements depend on the visa category and the facts of the case.

H-1B
For H-1B sponsorship, an employer generally files a certified Labor Condition Application (LCA) with the Department of Labor before submitting the petition to U.S. Citizenship and Immigration Services (USCIS). The LCA includes attestations concerning wages, working conditions, notice, and other statutory requirements. This is one reason a recruiter’s informal statement that sponsorship is possible is not the same as confirmation that the employer will pursue a particular case.
Ask whether the employer files H-1B cases for this position and what conditions it applies. Sponsorship can depend on the role, level, worksite, funding, or visa category; a general company statement may not settle whether this opening qualifies. Do not treat a positive answer as a guarantee of approval, since the employer’s willingness to support a process and the outcome of a case are separate matters.
Permanent employment through PERM
In most cases, permanent employment sponsorship involves the employer obtaining labor certification from the Department of Labor before filing the immigrant petition. The Department must certify that there are not sufficient U.S. workers able, willing, qualified, and available for the job, and that employing the foreign worker will not adversely affect similarly employed U.S. workers. Ask whether the employer supports this route and for which role or circumstances; do not assume a general sponsorship policy includes it.
When should I complete Form I-9 or provide documents?
Do not complete Form I-9 with a job application. USCIS employer guidance says an individual should complete it after accepting a position: Section 1 is due on or before the date of hire, and the employer must complete Section 2 within three business days.
Employees choose which acceptable documents to present for Form I-9. Employers generally may not demand a specific document based on citizenship or national origin. USCIS instructions also state that employees do not need to prove their citizenship, immigration status, or national origin when establishing employment authorization through Form I-9 or E-Verify. A recruiter may ask whether you have the legal right to work and whether you will need sponsorship, but that is different from requiring a passport, green card, or other particular document before an offer.
E-Verify does not replace the distinction between eligibility and sponsorship. It is an employer system that complements Form I-9, so a posting’s E-Verify requirement does not tell you whether the employer will file an employment-visa case. Nor does it change the rule that employees choose from acceptable Form I-9 documents rather than being required to present a particular document simply because of citizenship or national origin.
What are red flags in a posting or hiring conversation?
A sponsorship restriction is not automatically unlawful, and a request about work eligibility is not automatically improper. The concern is whether a restriction has a valid basis and whether document or verification rules are applied consistently.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
- A specific identity document is demanded before an offer. Be cautious if a recruiter insists on a passport, green card, or another particular document rather than discussing eligibility in general.
- A document is rejected because it is foreign. DOJ guidance says employers may not reject an apparently valid Form I-9 document on that basis.
- Extra proof is requested only from non-U.S. citizens. IER says employers may not apply verification rules inconsistently or demand more or different documents based on citizenship or national origin.
- A citizenship-only rule has no apparent explanation. Ask whether the restriction is tied to a law, regulation, executive order, government contract, or export-control rule. DOJ best practices advise that job postings should align with a legal requirement rather than incorrectly excluding citizenship statuses.
- You are told to pay employer H-1B petition costs. The Department of Labor says H-1B employers may not require workers to pay petition filing fees or certain employer business expenses.
If a conversation raises one of these issues, keep the wording factual, save the posting and messages, and seek guidance rather than sending documents you were not otherwise required to provide. A recruiter can ask whether you have the legal right to work and whether you will need employment-visa sponsorship; that is different from demanding extra or particular Form I-9 documents based on citizenship or national origin.

Preserve what you saw and ask for a written clarification tied to the exact job. Job-board text can change, and a recruiter’s general answer may not cover the role, worksite, or contract you are considering.
- Save the original wording. Keep a screenshot or PDF of the posting, including the title, location, and any authorization or sponsorship language.
- Ask a narrow follow-up. Quote the conflicting phrases and ask which policy applies to this opening, including whether it covers sponsorship at hire and later.
- Confirm the relevant conditions. Ask whether the answer differs by visa category, current authorization type, worksite, role, contract, or customer.
- Keep the reply. Save the recruiter’s written clarification with your copy of the posting before relying on it in a hiring decision.
- Get help with a possible discrimination or document issue. DOJ’s Immigrant and Employee Rights Section provides a worker hotline at 1-800-255-7688 and an employer hotline at 1-800-255-8155.
When you follow up, keep the two questions separate even if the original posting combines them. A concise written record can show whether the employer requires authorization by the start date, whether it supports a visa process now or later, and whether its answer is limited to a particular role or work arrangement. If the recruiter cannot answer, ask who can confirm the policy.
How should I compare two jobs that both say they sponsor?
Compare the actual policy rather than the headline phrase. “Sponsorship available” can conceal meaningful differences in category, timing, or role eligibility.
- Visa category: Ask whether the employer supports the particular employment-based category you may need, including whether permanent residence is within scope.
- Timing: Find out whether support is available at hire, only after a period of employment, or only when a specified condition is met.
- Current authorization: Ask how the policy applies to OPT/STEM OPT, an EAD, or a transfer from another employer, if relevant to you.
- Position limits: Confirm whether sponsorship depends on role, level, worksite, funding, contract, or customer requirements.
- Eligibility and next steps: Ask what conditions the employer applies and when it would decide whether to file.
- Written confirmation: Keep the employer’s answer tied to the specific opportunity, not just a general careers-page statement.
Compare answers on the same terms. One employer may mean it will consider a filing only for certain roles; another may support a category at hire but not a future change in status. Write down the category, timing, any eligibility conditions, and the exact role or worksite covered. A “yes” to sponsorship is most useful when you know what the employer means by sponsorship and what it does not promise.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteWhat is the practical decision rule?
Treat a posting as clear only when you know both whether you must already be authorized at the start date and whether the employer will support any sponsorship you may need now or later. If either answer is missing, ambiguous, or contradicted elsewhere, ask before treating the role as a match.
Frequently Asked Questions
Does “sponsorship considered” mean the company has to sponsor me?
No. The phrase indicates possible consideration, not a promise to file a petition or a guarantee that a case will be approved. Ask what conditions the employer applies and whether it can confirm the policy for your specific opening.

Can a job-board application answer replace the recruiter’s clarification?
Not necessarily. A checkbox may record your response, but it may not explain how the employer defines future sponsorship or which role-specific restrictions apply. Keep your answer accurate and request clarification when the available choices do not fit your circumstances.
Can I ask about sponsorship before an interview?
Yes. Asking whether the role supports a visa category or future sponsorship can help you decide whether to proceed. Keep the question focused on the position’s policy rather than sending immigration documents or more personal information than the employer needs at that stage.
Does an “E-Verify required” notice mean the employer will sponsor a visa?
No. E-Verify complements Form I-9; its use does not tell you whether the company will sponsor an employment visa. Ask the recruiter the sponsorship question separately.
When do I complete Form I-9, and can the employer choose my documents?
You do not complete Form I-9 with an application. After accepting a position, Section 1 is due on or before your hire date and the employer completes Section 2 within three business days. Employees choose which acceptable documents to present; employers generally may not demand a particular document based on citizenship or national origin.
What should I do if a posting says “U.S. citizens only”?
Ask whether the restriction is tied to a law, regulation, executive order, government contract, or export-control rule. DOJ best practices say job-posting restrictions should align with a legal requirement and should not incorrectly exclude citizenship statuses. Save the wording if you have concerns.
Can an H-1B employer require me to pay its petition costs?
The Department of Labor says H-1B employers may not require workers to pay petition filing fees or certain employer business expenses. If you are told to pay, keep the request in writing and seek appropriate guidance.
