UK TV licence and Netflix or YouTube: what the law says in 2026

No new UK law currently makes ordinary Netflix or YouTube viewing require a TV Licence. On 27 October 2026, a licence is still required for live television on any channel or service and for watching or downloading any BBC programme on BBC iPlayer. Households that watch only on-demand Netflix, ordinary on-demand YouTube videos and other listed streaming libraries, without using iPlayer, do not need one. The government is reviewing BBC funding and could change the rules later, but claims that a “YouTube tax” is already in force are incorrect.

Is the UK making Netflix and YouTube viewing licenceable?

Not under the law in force on 27 October 2026. The legal test is what you watch, not whether you own a television, phone, tablet, computer or streaming device.

A TV Licence is required for live television on any channel or service, including a live broadcast delivered through an internet streaming platform. It is also required to watch or download any BBC programme on BBC iPlayer, whether the programme is live or on demand.

What can I watch without a TV Licence?

If your household avoids live television and does not use BBC iPlayer, the following on-demand viewing is outside the current licence requirement:

Viewing activity Licence required now? Important qualification
On-demand Netflix programmes No Applies when the programme is watched on demand, not as a live broadcast.
Ordinary on-demand YouTube videos No A live stream is treated differently from a video watched after it has been posted.
On-demand Disney Plus, Amazon Prime Video or All 4 No The exemption depends on avoiding live television and BBC iPlayer.
Live television on any channel or service Yes The platform does not matter; a qualifying live broadcast requires a licence.
BBC iPlayer programmes Yes This includes both streaming and downloading, and both live and on-demand programmes.

How much does a TV Licence cost in 2026?

The annual colour licence costs £180 from 1 April 2026, an increase of £5.50. A black-and-white licence costs £60.50. People aged over 75 who receive Pension Credit can obtain a free licence.

Watching live television or BBC iPlayer without the required licence can lead to prosecution and a fine of up to £1,000. The liability follows the viewing activity, so buying a television or keeping a streaming device at home does not by itself create an obligation.

Why are reports saying the rules are changing?

The government is conducting a BBC Royal Charter Review. Its Green Paper examines the scope of the licence fee, differential rates, concessions, collection and enforcement, and ways for the BBC to raise more commercial income.

  • No more fumbling in the dark: See what you’re pressing with backlit buttons.

The Green Paper does not select a final model. It says the government has not ruled out keeping the current licence fee and its current structure, and is keeping an open mind about which activities or services might require a licence. It also discusses possible licence-status verification for BBC online services such as iPlayer.

Crucially, the Green Paper says the government is not considering a levy on streaming-service revenues. That means the review is not an announced charge on Netflix or YouTube subscriptions.

When could new BBC licence rules start?

A parliamentary answer dated 19 October 2026 says policy decisions will be set out in a future White Paper expected by the end of 2026. The current BBC Charter expires on 31 December 2027, and a renewed Charter is expected to begin on 1 January 2028.

  • Compact without compromises: Our sleek design won’t block neighboring HDMI ports, so you can switch from streaming to gaming with ease. Plus, it’s designed to stay hidden behind your TV, keeping wires neatly out of sight

Those dates describe the policy timetable, not a completed change to the licence law. Until Parliament or the government publishes an enacted measure or official decision, treat statements that all Netflix or YouTube viewing is already licenceable as unverified.

Can I cancel my licence if I only stream on demand?

Yes, provided everyone in the household genuinely limits viewing to activities that do not require a licence. Before cancelling, check each person’s use of live channels, live events carried by streaming platforms and BBC iPlayer, including downloads.

  1. List every service and the way it is used, separating live broadcasts from programmes selected on demand.
  2. Check whether anyone watches or downloads BBC programmes through iPlayer; that use always requires a licence under the current rules.
  3. If there is no live television and no iPlayer use, cancel through the official TV Licensing process and keep the confirmation for your records.
  4. Reassess if your viewing changes, because starting live television or iPlayer use restores the licence requirement.

How widespread is the licence system, and why is reform being considered?

Department for Culture, Media and Sport figures show that 23.7 million UK households held a TV Licence in 2024/25. Sales fell 8.3% between 2014/15 and 2024/25, equivalent to about 2.1 million fewer sales. Broadcast viewing on television sets was 21% lower than the Green Paper’s 2019 baseline.

Those changes help explain why ministers are reviewing a funding model built around broadcast viewing while audiences increasingly watch on demand. They do not, however, change the present legal boundary between live or iPlayer use and ordinary on-demand streaming.

What should households believe about a “YouTube tax”?

  • True today: live television on any service and all BBC iPlayer viewing require a licence.
  • Also true today: on-demand Netflix, ordinary on-demand YouTube and the other listed on-demand libraries do not require one when iPlayer and live television are not used.
  • Not enacted: a rule making every Netflix or YouTube video licenceable.
  • Under review: the licence’s scope, concessions, collection, enforcement and possible online-status verification.

For now, make the decision from your household’s actual viewing pattern and the £180 annual price, not from headlines that present consultation proposals as settled law.

Frequently Asked Questions

Does paying for a Netflix or YouTube subscription replace a TV Licence?

No. A streaming subscription and the TV Licence are separate obligations. Paying for a service does not authorise live television or BBC iPlayer use, while on-demand use alone remains outside the current licence requirement.

Do live YouTube premieres or sports streams need a licence?

A programme being delivered live is the relevant factor, even if it is hosted on a video platform rather than a traditional television channel. Watching a qualifying live stream therefore falls under the live-TV rule; watching the recording later on demand does not.

Could the government start charging for past Netflix viewing?

No backdated charge has been announced. The published timetable points to a future White Paper and later Charter or legislative decisions, so any new liability would need to be set out in an official measure.

Will BBC iPlayer be able to check whether my household has a licence?

The Green Paper raises possible licence-status verification for BBC online services, including iPlayer, but does not establish a final system. Its technology, legal basis and start date remain undecided.
