Yes—you can legally ship a game made with Unreal Engine and AI-assisted content, but the engine license, each third-party asset license, AI provider terms, and your human creative contribution must all line up. Unreal Engine code, Examples, and Starter Content are governed by the Unreal Engine EULA, while Fab and Marketplace products have separate licenses. Epic’s current royalty model lists 5% of lifetime gross revenue above $1 million directly attributable to a Unreal Engine product; some other commercial uses use seat licensing instead. AI output is not automatically yours under copyright law, and identifiable people, brands, voices, photographs, scans, and other source material can create rights problems even when you recreated them yourself. Use the checklist below to build a rights record before release, disclose material AI-generated marketplace content, and keep replacement assets ready if a license is withdrawn or challenged.
Is it legal to ship an AI-assisted game made in Unreal Engine?
Usually, yes, provided you have permission for every component and comply with the relevant disclosure and revenue terms. “AI-assisted” is not a single legal category: an AI tool may help brainstorm dialogue, generate a texture, produce a voice, or modify a purchased mesh, and each use can involve different copyright, contract, trademark, publicity, privacy, or data-protection issues.

For a U.S.-centered release, separate four questions:
- Are you licensed to use Unreal Engine and distribute the finished product on the intended platforms?
- Does each Fab, Marketplace, plugin, or external asset license allow your planned commercial use, modification, and redistribution?
- Do the AI provider’s terms allow your inputs and outputs for this project, and do they restrict training, resale, or use of confidential material?
- What part of the final expression was created by people, rather than generated without meaningful human control?
Passing one question does not answer the others. A legally obtained model can still depict an unconsenting person; a human-edited AI image can still contain an unlicensed logo; and an otherwise compliant project can incur royalties or seat fees under the engine agreement.

What does the Unreal Engine license cover?
Unreal Engine code, Examples, and Starter Content are licensed under the Unreal Engine EULA. Treat that technology as a separate rights category from content bought or downloaded through Fab or the Marketplace. Record the exact engine version and the EULA version and date that applied when you made the release decision; terms and prices can change.
Epic’s current licensing page describes these headline commercial options:
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →| Situation | Published figure or rule | What to verify for your project |
|---|---|---|
| Royalty-model Unreal Engine product | 5% of lifetime gross revenue above $1 million directly attributable to the product | Whether your revenue is directly attributable, how lifetime revenue is calculated, reporting dates, exemptions, and platform-specific treatment |
| Listed seat-based commercial license | $1,850 per seat per year | Whether your application qualifies, which personnel need seats, renewal terms, and whether distribution or support obligations apply |
| Other commercial uses | May require seat licensing rather than the game royalty model | Whether the project is a game or another commercial application and which distribution model applies |
The $1 million threshold and 5% rate are the figures shown on Epic’s current licensing page accessed in 2026, not a promise that every product qualifies for the royalty model. Put the applicable license model, revenue classification, release platforms, and the page or agreement version in your rights register. Preserve required Unreal copyright and trademark notices in credits when your product has credits; the EULA supplies the notices and formatting obligations.
Can Unreal Engine itself be used as training data for an AI tool?
Do not assume that material licensed for game development may be uploaded to train a model. The Unreal Engine EULA addresses use of Licensed Technology as training input or as prompt-based input where the generative program trains on the input data. Its wording prohibits uses that “result in using the Licensed Technology as a training input to any Generative AI Program or as prompt-based input where the Generative AI Program trains on input data.” Check the current EULA before sending engine code, examples, source assets, or confidential project material to a provider, and disable provider training where the provider offers that control.
How are Fab and Marketplace assets licensed?
Fab and Marketplace assets are Content under their own terms; an Unreal Engine license does not automatically grant rights to a third-party pack. Marketplace sellers must have legal rights to distribute every asset they submit. When you buy Content, the Epic Content License Agreement generally gives you a non-exclusive, worldwide, perpetual license, but that grant is subject to the agreement’s restrictions.

Save the product page, seller name, invoice, downloaded version, license text, and date of acquisition. A Marketplace license is not a transfer of ownership, and source-code sublicensing is prohibited under the Marketplace rules. Therefore, package third-party code so players receive only what the license permits; do not expose source files merely because your build system contains them.

A perpetual license is useful evidence, but do not assume every practical risk disappears when a listing is withdrawn. The product may contain separate components, external dependencies, or a correction to the seller’s rights. Archive the terms and files you relied on, monitor notices, and maintain a substitute asset for anything essential to a shippable build.
Who owns AI-generated game art, code, music, or dialogue?
In the United States, copyright protects human-authored expression. The U.S. Copyright Office’s Part 2 report states: “Copyright does not extend to purely AI-generated material, or material where there is insufficient human control over the expressive elements.” It also concludes that, based on current generally available technology, “prompts do not alone provide sufficient control.”
That does not make an AI-assisted asset unusable. It means you should identify and preserve the human-authored expression that makes the asset protectable: selecting and arranging outputs, compositing multiple sources, painting or modeling substantial elements, writing or rewriting dialogue, directing a performance, editing timing and synchronization, and making creative choices about the final presentation. A mechanical upscale, color correction, or acceptance of a single generated result may provide little authorship by itself.
How should a studio document human contribution?
For every material AI-assisted asset, keep the prompt and output history, the model or service name and version, dates, input references, rejected alternatives, and the project files showing your edits. Annotate the human decisions that determine expressive elements: which outputs were selected, what was redrawn, how layers were composited, which animation beats were authored, or how a music cue was structured and mixed. Keep the unedited output as well as the final file so you can explain the chain of creation.

If you apply for U.S. copyright registration, disclose AI-generated material and claim only the human-authored portions, including creative selection, coordination, arrangement, or modifications. The Copyright Office received more than 10,000 public comments in its 2023 AI initiative, and its guidance may evolve; archive the guidance and application practice used for your filing.
What rights must be cleared beyond copyright?
Copyright clearance is only one layer. A developer can independently recreate a subject and still infringe another person’s trademark, publicity, privacy, or likeness rights. Run a separate review for each identifiable or recognizable element.
- People and likenesses: Obtain written releases for identifiable faces, bodies, names, biographies, gestures, and distinctive personas. A generated or reconstructed likeness can still implicate publicity or privacy rights.
- Voices and performances: Obtain performer consent covering the intended voice model, game, territories, platforms, marketing, updates, and duration. Do not infer consent from a publicly available recording.
- Trademarks and trade dress: Remove or license real logos, product designs, fictionalized marks that are confusingly similar, and distinctive packaging or uniforms. Check menus, background signage, textures, props, and promotional screenshots, not just hero assets.
- Photographs, scans, and text: Verify the original creator, model release where relevant, modification rights, commercial use, and sublicensing for every external photograph, 3D scan, font, quotation, or written passage.
- Training and input material: Confirm that an AI provider permits the material you upload and does not use confidential or licensed inputs for model training in a way your contract forbids.
Ask for written warranties from contractors and asset sellers that they own or can license what they delivered, but treat a warranty as a risk-allocation tool, not a substitute for your own review.
Do I have to disclose AI assets in a Marketplace submission?
Yes, when a material portion of Marketplace Content was created using generative AI. Epic’s Marketplace Distribution Agreement says: “If your Content is created using Generative AI Programs, you must tag your Content using the ‘CreatedWithAI’ tag.” Apply the tag before submission, save a screenshot or export showing it, and retain the underlying provenance record.
The marketplace disclosure is a contractual and catalog obligation; it does not decide whether an end-user game must announce every AI-assisted texture or line of dialogue. Check the platform, publisher, funding, labor, and consumer-protection rules that apply to your release. If a partner contract requires broader disclosure, follow that contract even when the Marketplace tag is not involved.

How do I build an Unreal AI asset-rights register?
Use one row per engine component, plugin, asset, generated file, and externally supplied contribution. Complete the register before content lock, then update it for patches, DLC, and major engine upgrades.
- Identify the build context. Record the exact Unreal Engine version, EULA version and date, project license model, revenue classification, target platforms, territories, and whether the product is a game or another commercial application.
- Separate technology from content. Create distinct entries for Epic Licensed Technology, Fab or Marketplace Content, plugins, open-source dependencies, and studio-created files. Do not rely on a single “third-party assets” folder.
- Capture acquisition evidence. Store each product page, seller, invoice, downloaded version, license, and date. Note commercial-use scope, modification rights, source-file access, attribution, redistribution limits, territory, term, and any AI disclosure condition.
- Audit code and plugins. Record every dependency license and check whether copyleft, notice, source-distribution, patent, or attribution obligations conflict with your intended console, PC, mobile, cloud, or boxed distribution. Marketplace rules prohibit certain third-party licenses that would impose conflicting terms.
- Clear external material. For every model, texture, animation, sound, voice, font, logo, photograph, scan, or text, record creator, source, grant, territory, term, attribution, modification, commercial-use, and sublicensing rights.
- Collect releases. Obtain signed releases for identifiable people, voices, likenesses, and publicity rights. Link each release to the asset identifier and the approved uses.
- Document AI work. Preserve prompts, outputs, provider terms, training settings, edits, selections, compositing, and other human contributions. Record whether the provider permits commercial use and whether it claims rights in inputs or outputs.
- Apply disclosures. Add Epic’s CreatedWithAI tag to Marketplace Content containing a material AI-generated portion and preserve proof. For a U.S. copyright registration, identify AI-generated material and claim only human-authored expression.
- Prepare credits and notices. Keep Unreal copyright and trademark notices required by the EULA, plus asset-specific attributions and open-source notices, in the locations required by each license.
- Run a launch gate. Have legal or rights owners sign off on unresolved items, archive the evidence used for the decision, and test a clean build with all notices and attributions present.
How should I choose between licensing and AI workflows?
Compare options by risk and control, not simply by purchase price. The same workflow can be acceptable for an internal prototype and unsuitable for a commercial release.
| Decision | Key comparison points | Warning sign |
|---|---|---|
| Engine licensing model | Runtime dependency, revenue threshold, platform distribution, and game versus non-game classification | Assuming the 5% royalty model applies to a non-game commercial application |
| Marketplace versus self-created asset | Commercial scope, redistribution, source files, attribution, geographic or term limits, AI disclosure, and withdrawal survival | No archived license or no permission to ship source files included in your build |
| AI-assisted workflow | Human creative control, provider input/output terms, training-use restrictions, provenance, and registration or disclosure duties | A single prompt-generated result with no edit history or unclear provider rights |
| Contractor or contributor delivery | Ownership or license grant, warranties, releases, confidentiality, portfolio use, and responsibility for third-party material | “Royalty-free” language without a defined grant or sublicensing permission |
What should happen before launch and after release?
At content lock, search the entire project and marketing package for unregistered files, temporary placeholder art, debug assets, copied references, and generated outputs that bypassed intake. Reconcile the packaged build against the rights register, verify credits on every platform build, and confirm that the selected engine license still matches revenue and distribution plans.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsCreate a takedown and replacement plan. List assets that could be removed, expired, revoked, or challenged; identify who can replace each one; keep editable substitutes; and document the process for issuing a patch, delisting a DLC item, or disabling a disputed asset. Recheck licenses when an engine version changes, a Marketplace seller posts a correction, a provider changes AI terms, or you add a new platform, territory, voice, or marketing use.
This checklist is U.S.-centered and based on Epic’s terms and current Copyright Office guidance, not legal advice. For high-risk likenesses, brands, disputed ownership, or releases outside the United States, obtain counsel in the relevant jurisdiction and archive the exact terms used for the release decision.

Frequently Asked Questions
Can I transfer an Unreal project to a publisher or co-developer?
Review the EULA, seat agreement, and every Content license before transferring files. A transfer of project ownership does not automatically transfer a Marketplace entitlement, source-code right, contributor release, or obligation to preserve notices; document which party holds and may exercise each right.
What evidence is most useful if an AI asset is challenged?
Keep dated source files, provider terms, prompts, outputs, edit histories, invoices, releases, and the exact build in which the asset shipped. Hashing or otherwise preserving immutable copies can help establish chronology, while a short rights memo should explain the human-authored contribution and the license relied upon.
Recommended Free Tools
Does changing an AI image’s colors make it copyrightable?
A minor filter or automatic enhancement may not add enough original expression. Copyright analysis focuses on the human choices that determine expressive elements, such as redrawing forms, composing multiple sources, designing new details, or directing and editing a sequence.
Can players submit AI-generated skins or mods?
Use contributor terms that address ownership, commercial permission, publicity and trademark rights, AI disclosure, moderation, takedown, and indemnity. Require submitters to identify generated material and reject content that includes recognizable people, logos, or copied third-party assets without permission.
When should a studio recheck its rights register?
Recheck at prototype approval, content lock, submission, launch, each major patch or DLC, and whenever an engine, provider, seller, platform, territory, or marketing use changes. A periodic review is especially important for subscriptions, licenses with term limits, and assets obtained from marketplaces that can change listings.
