Video Game Beer Licensing Explained: How to Verify an Official Can

A video game beer is officially licensed only when the game’s intellectual-property owner gives a brewery written permission to use the franchise’s trademarks—and, where artwork is reproduced, its copyrights—with contractual quality-control rights. A federal Certificate of Label Approval (COLA) from the Alcohol and Tobacco Tax and Trade Bureau (TTB) is a separate requirement for most beer sold across US state lines. TTB approval means the alcohol label meets federal rules; it does not prove that the game publisher authorized the name, logo, or artwork.

That distinction explains the current Grand Theft Auto-themed labels reported in TTB’s database: they show regulatory approval for specific packaging, but neither the publisher nor the brewery had publicly confirmed a licensing deal as of October 29, 2026. By contrast, the 2015 Fallout Beer made with Carlsberg in the United Kingdom and Jones Soda’s 2026 Vault-Tec beverage collaboration are documented licensed products.

What legally makes a video game beer “officially licensed”?

“Officially licensed” describes a private intellectual-property agreement, not a government seal. The game owner (the licensor) grants a brewery (the licensee) defined rights to use particular marks, images, territories, product categories and sales channels. The agreement normally includes payment terms, a term and termination rights, and approval procedures for the recipe presentation, artwork, packaging and advertising.

Trademark permission covers the source-identifying brand

A trademark license is needed for names and symbols that tell shoppers who stands behind the drink: a game title, publisher logo, fictional beer name, slogan, character logo or distinctive trade dress. The scope is usually limited. A license for beer does not automatically cover spirits, clothing, games or films, and a license in one country may not cover another.

Copyright permission is a separate grant

Character illustrations, key art, distinctive can artwork, music and other creative assets are generally copyrighted. As attorney Zachary Strebeck explains, “Pokemon the word mark and the Pikachu logo? Those are trademarks. The character art, game code, and music? That’s copyright. You often need licenses for both, and one doesn’t cover the other.” A beer can using a game logo but copied character art therefore may require both trademark and copyright permissions.

Quality control is part of the deal

US trademark law expects a licensor to control the quality of goods sold under its mark. If an owner grants permission but does not set or enforce standards, courts can treat the arrangement as a “naked license” and find the mark abandoned. A real beverage license commonly gives the publisher style-guide rules, artwork approval, the right to inspect or reject packaging, and controls over claims that could confuse buyers about the drink’s source.

Practitioner estimates put entertainment and game trademark royalties at roughly 5–15% of net receipts, with consumer-product deals commonly in a 2–15% range. Those are negotiating benchmarks, not a government schedule and not evidence of what any particular beer deal paid.

Is a TTB COLA the same as a trademark license?

No. A COLA is a federal alcohol-label approval; a trademark license is the publisher’s private authorization. Either can exist without the other.

Question COLA IP license
Who issues or grants it? TTB, a federal regulator The game’s trademark and copyright owner
What does it cover? Truthful, non-misleading alcohol labeling and mandatory statements Use of specified names, logos, artwork and related brand assets
Does it prove the game owner approved the beer? No Yes, within the contract’s scope
Does it authorize interstate sale? It is required for most malt beverages introduced into interstate commerce No; state and federal alcohol compliance remain separate

TTB states that its review asks whether labels are truthful, not misleading and complete. It may approve a brand name that resembles or matches another company’s mark; trademark ownership and infringement are outside the COLA decision. As Cohn Legal puts it: “A COLA does not grant trademark ownership and does not establish that the approved brand may be used without infringing another party’s rights.”

When a COLA is required

For domestic beer, the bottler must obtain approval before bottling when the product will be sold, shipped or otherwise introduced in interstate commerce. Imported beer requires the importer’s COLA before removal from Customs custody. TTB’s covered categories also include distilled spirits and wine between 7% and 24% ABV. A malt beverage sold only inside the state where it was made needs neither a COLA nor a certificate of exemption. Wines under 7% ABV and beers that do not contain both malted barley and hops can fall under FDA food-label rules instead.

Applications use COLAs Online and TTB Form 5100.31. If a formula requires separate approval because of flavors, colors, artificial sweeteners or other ingredients, that review comes first. TTB says there is no application fee and approval often takes less than a week. The agency also lists allowable revisions, so a minor artwork change may not require a fresh certificate.

How to read the public record

Anyone can search TTB’s Public COLA Registry by brand, basic permit or date. The registry shows approved labels; rejected applications and formulas are not public. Certificates generally do not expire, but TTB can revoke them and holders can surrender them. A COLA does not reveal a release date, price or distribution map.

Registry IDs encode the year and Julian day received, filing method and sequence number. For example, an ID beginning 26295 indicates a filing received in 2026 on day 295 (October 22). That code helps date a filing, but it still does not prove a publisher relationship.

What has to appear on a US beer label?

Game artwork cannot replace the federal information required on a malt-beverage package. Current guidance applies 27 CFR Part 7 and Part 16, including the post-2022 numbering in 27 CFR 7.63.

Label element What the package must show
Brand name The name under which the beer is sold, without misleading claims about identity, age or origin
Class or type Beer, ale, lager, stout, porter, malt beverage or another recognized designation
Brewer, bottler or importer Name and address, with wording such as “Brewed by” or “Brewed and bottled by” where applicable
Net contents US measure such as 12 fl oz; metric may be added but not substituted
Alcohol content Usually optional federally for beer, but required when alcohol comes from added flavors or other nonbeverage ingredients; state rules may also require it
Conditional disclosures Statements for applicable Yellow No. 5, sulfites at 10 ppm or more, aspartame (PKU), and cochineal or carmine
Government Warning The exact statutory warning required by 27 CFR 16.21
Country of origin Required for imported beer

The warning must read:

GOVERNMENT WARNING: (1) According to the Surgeon General, women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. (2) Consumption of alcoholic beverages impairs your ability to drive a car or operate machinery, and may cause health problems.

Mandatory information must be readily legible on a contrasting background. Type must be at least 2 mm for containers larger than half a pint and 1 mm for smaller containers. On typical 12-ounce and 16-ounce packages (over 237 ml up to 3 liters), the Government Warning must be at least 2 mm tall and use no more than 25 characters per inch. If ABV is printed, the permitted tolerance is 0.3 percentage points either way: a stated 6.0% may test from 5.7% to 6.3%. TTB guidance also says the abbreviation “ABV” itself is not used on the label; forms such as “ALC/VOL” appear instead.

Why does an in-game beer name not authorize a real can?

A fictional beer can be lawful world-building inside an expressive game and still require a commercial license when a brewery puts that name on a competing product. The Rogers test, used in some circuits for expressive works, protects an outsider’s mark when the use has artistic relevance and does not explicitly mislead consumers about sponsorship. Courts have applied that reasoning to marks depicted inside games, including the Grand Theft Auto: San Andreas “Pig Pen” dispute.

The analysis changes when the mark is used as the product’s own source identifier on a box, store page, title, downloadable-content name or merchandise. That is the situation for a branded beer can. The Supreme Court’s 2023 Jack Daniel’s decision illustrates why a seller using a mark as a source designation for a competing consumer product cannot assume Rogers will shield it.

In-game existence is therefore evidence that a publisher created a fictional brand, not evidence that a brewery received permission to commercialize it. “Used under license” language, a named official partner and publisher-approved credits are stronger signals than visual similarity or a fan’s tap-list photograph.

Which real game beverages show the difference?

Carlsberg Fallout Beer: documented licensed beer

In 2015, Bethesda and Carlsberg released a limited Fallout Beer in the United Kingdom to promote Fallout 4. Digital Trends reported cases of 12 bottles pre-ordered through Amazon UK for £30, with shipping scheduled for November 5, five days before the game’s release. The beer was described as a light-colored pilsner lager with zesty hop character and floral aroma. It was a UK run, not a US nationwide product.

Jones Soda Vault-Tec Beverage Ration: licensed drink, not beer

In June 2026, The Licensing Letter reported Jones Soda’s licensing collaboration with Bethesda Softworks. The Vault-Tec Official Beverage Ration returned through US club-retail partners with 12 flavors, including new Nuka-Orange, Nuka-Victory and Nuka-Cherry varieties. It is soda, but the publisher collaboration and the word “Official” demonstrate the same authorization path a beer would need.

GTA-themed COLAs: label-approved, license unannounced

Reports from GTAVice.net and related coverage identified three TTB-approved labels filed to Tripping Animals Brewing in Doral, Florida: Pißwasser on September 29, 2026; No Mames Vice City on October 9; and Patriot on October 15. No Mames Vice City was reported as a 6% ABV lager with GTA VI branding. TweakTown reported 4.2% alcohol by volume and the slogan “Never Refuse a Patriot” on the Patriot label.

  • Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft

Neither Rockstar Games nor Tripping Animals had publicly announced a collaboration as of October 29, 2026. TweakTown summarized the legal status accurately: “TTB approval clears the artwork and wording on the Pißwasser, Patriot, and No Mames Vice City packaging. It does not, by itself, establish that the beers are authorized for retail sale or will reach shelves.” There was no confirmed US price, ship date or retail listing, and no retrieved public TTB ID number for these reports. GTA VI was scheduled for November 19, 2026, but that date does not turn the labels into confirmed launch products.

Other Fallout filings show why publishers protect marks before licensing them. ZeniMax filed “Nuka Dark” for liquor, bourbon, spirits, wine, beer, ale, lager, stout and related alcoholic goods in 2018. In-game Nuka-Cola Dark is described as 35% ABV, but that fictional specification is not a recipe or approval for a real beverage.

How can you check whether a game beer is authentic?

Use several independent signals; no single badge is conclusive.

  1. Find a publisher or brewery announcement. Look for a named collaboration, territory and product category rather than a social post that only shows artwork.
  2. Read the package credits. “Used under license from” language, an official-partner statement and trademark notices that identify the game owner indicate a claimed authorization.
  3. Check trademark ownership. Search USPTO records for the game title and fictional beer name. Beer is generally International Class 32; wine and spirits are generally Class 33. Software and entertainment registrations in Classes 9 and 41 can still matter when a famous game mark appears on a drink.
  4. Search the TTB registry. Match the brand, label image, brewer or bottler and class/type. A certificate confirms federal label approval, not the IP deal.
  5. Audit the mandatory copy. Confirm the exact Government Warning, net contents, class/type and responsible brewer or importer. Missing or paraphrased required text is a compliance warning.
  6. Verify geography and channel. A UK limited run, a Florida taproom release and a nationwide US launch are different claims. A federal COLA does not complete state registration or distribution requirements.

Do not treat a COLA PDF, fan art, an in-game appearance, or a brewery located near a game’s fictional setting as proof of licensing. A brewery in Doral is geographically suggestive for a Vice City theme, but location is not authorization.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a brewery sell a game-themed beer without the publisher’s permission?

It can sometimes obtain a COLA, but that does not make the product safe from intellectual-property claims. The game owner may demand that the brewery stop using the mark, pursue trademark infringement or dilution claims, and assert copyright claims if artwork was copied. A disclaimer or “fan brew” label may help explain intent, but it does not automatically permit use of a mark as the product’s commercial source identifier.

Federal approval also does not settle state label registration, state alcohol-content rules, FTC advertising claims, formula changes or FDA ingredient requirements outside TTB’s label review. A brewery planning a multi-state launch needs separate compliance work for those jurisdictions.

What labeling changes could affect future licensed beers?

TTB’s January 2025 Notice 237 proposals would create a mandatory Alcohol Facts panel with serving size, servings per container, ABV, calories, carbohydrates, fat and protein, plus major-allergen labeling. The comment period closed in August 2025, and the proposal contemplated five years for compliance if finalized. As of October 2026, those requirements remained proposals, not final law, so they should not be used to judge a current can.

Frequently Asked Questions

Does a beer sold only in its home state need a COLA?

A malt beverage sold solely within the state where it was made generally does not need a COLA or certificate of exemption. Once the product enters interstate commerce, the domestic bottler normally needs a COLA before bottling.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a trademark license cover the artwork on a game beer?

Not automatically. Names and logos are usually trademark rights, while character art and other illustrations are copyright works. The contract should expressly cover each asset the brewery prints or uses in advertising.

Can TTB revoke an approved beer label?

Yes. Approved certificates generally have no expiration date, but TTB can revoke them, and a holder can surrender one. An approved certificate also does not show whether the beer was ever released or how widely it was distributed.

What does “used under license” tell a collector?

It is a claim that the named rights holder authorized the use, usually under a controlled commercial agreement. You should still match the statement to a publisher announcement, trademark owner and the brewery identified on the package.
