What Do Copyright, Trademark, and Patent Protect in a Board Game?

In the United States, copyright can protect a board game’s original written and visual expression; trademark can protect a name or logo used to identify the source of goods; and a patent can protect a qualifying functional invention or ornamental article design. None automatically gives an owner control over every part of a game. A rulebook’s wording, the method of play, the game’s name, its artwork, and a novel physical component raise different questions.

This guide explains those distinctions and the practical steps involved. It reflects U.S. sources reviewed in October 2026; it is general information, not a legal assessment of any particular game.

At a glance

Name Best for Key spec Free plan / price Checked
Copyright Original fixed writing and artwork For many works created since 1978: author’s life plus 70 years, with exceptions Published 2026 electronic filing examples: $45 for a qualifying single-author application; $65 for a standard application Nov 2026
Trademark A name, logo, or design that identifies the source of goods Continued use and maintenance are required USPTO electronic base application: $350 per class in the 2026 schedule Nov 2026
Patent A qualifying functional invention or ornamental article design Utility: generally up to 20 years from relevant nonprovisional filing; design: 15 years from grant Not stated; search, examination, and other costs can affect the total Nov 2026

Filing fees are examples from the U.S. Copyright Office and USPTO’s 2026 schedules, not all-in estimates. Eligibility, application type, trademark classes, extra fees, and patent work can change what an applicant pays.

What does each right protect in a board game?

The key is to identify the particular asset rather than treating “the game” as one indivisible thing. A single title can include material that falls into different legal categories.

Game element Right that may apply What the right addresses
Rulebook prose, card text, or other original writing Copyright The original wording as fixed in a medium, not the general method of play described by it.
Original illustrations, board graphics, or sufficiently creative logo artwork Copyright Qualifying visual expression. Copyright in artwork is distinct from trademark significance.
Game title or logo used to identify the goods’ source Trademark The source-identifying mark in relation to goods or services, subject to protectability and conflict analysis.
A novel functional mechanism or process Utility patent, if eligible The claimed invention or process, not simply the fact that the game idea is clever.
An ornamental design for a physical article Design patent, if eligible The qualifying ornamental design of the article, rather than its functional idea.

These categories can overlap in a project without becoming interchangeable rights. A logo, for example, may contain original artwork and also function as a mark identifying a game’s source. The U.S. Copyright Office describes board games and card games among literary-work examples and board games’ visual aspects among visual-art examples; those categories do not mean every submission necessarily qualifies for registration. See the Copyright Office’s copyright FAQ.

Can I copyright my board game’s rules?

Copyright may protect sufficiently original wording used to explain rules, but it does not give the writer ownership of the underlying gameplay method or idea. Writing rules down can protect the expression without granting an exclusive right to the play system those words describe.

Separate the explanation from the method

Suppose a rulebook explains that players take turns moving pieces, collecting resources, and scoring points. The exact original prose may be protected as expression; the general method of taking turns or pursuing a scoring objective is not thereby owned. Someone who independently describes a similar method in different wording is not automatically copying the first rulebook’s protected expression.

That distinction is why “rules are protected” and “rules are not protected” are both too broad as blanket claims. The relevant question is what was copied: original text or art, or the underlying idea or method. This is a general distinction, not a determination that any particular rulebook is original enough or that any particular use is lawful.

What about cards, boards, and illustrations?

Original expression can appear outside the rulebook. The Copyright Office identifies board games’ visual aspects as a visual-art category, while game and card material can also contain literary expression. A card’s original narrative text or illustration is a different asset from the action or mechanic it communicates. The precise material and degree of original expression matter.

Can a game title be copyrighted?

A title, by itself, is not copyrightable as a title. A logo’s sufficiently original artwork may qualify separately for copyright, while the logo or name may also operate as a trademark if it identifies the source of goods. The two questions are not substitutes for each other.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I trademark my board game name?

A game name or logo may qualify as a trademark when it is used as a source identifier for goods, but choosing a name or reserving a web address does not alone establish trademark rights. Protectability and conflicts depend on the mark, how it is used, and related goods or services.

What to assess before settling on a name

  • Source-identifying use: Consider whether the name tells customers who provides the game, rather than merely describing a feature or being used as a title.
  • Distinctiveness: A mark’s strength affects the analysis. The USPTO’s trademark process overview discusses the steps and factors relevant to an application.
  • Similar marks: Look for marks that are similar in appearance, sound, meaning, or overall impression, especially in connection with related goods. A different spelling does not by itself settle whether marks conflict.
  • Relevant goods and services: A name used for a board game should be assessed in its commercial context, not as a word considered in isolation.
  • Actual use: Registering a domain or forming a company under a name is not the same thing as using a mark to identify goods.

A search is a screening step, not a guarantee that an application will be accepted or that no other party has rights. If the name matters commercially, the relevant goods, existing marks, and intended use call for a fact-specific assessment.

Does trademark give ownership of a word everywhere?

No. Trademark addresses a sign’s role as an identifier for specified goods or services, subject to the applicable analysis. It is not a general right to control every use of a word, and it does not grant ownership of a game mechanic simply because that mechanic is associated with a mark.

Can you patent a board game idea?

Not merely because the concept is original or clever. A patent requires a qualifying claimed invention or design and must satisfy applicable eligibility, novelty, and nonobviousness requirements. The USPTO distinguishes utility patents for functional inventions or processes from design patents for qualifying ornamental designs.

Utility patent or design patent?

  • Utility patent: The relevant subject is a qualifying functional invention or process, such as a potentially novel physical mechanism—not an abstract idea alone.
  • Design patent: The relevant subject is a qualifying ornamental design for an article. It addresses appearance, not the game’s abstract rules or functional concept.

The USPTO states that a design patent lasts 15 years from the date of grant. Utility patents generally last up to 20 years from the relevant nonprovisional filing date. Those are general term descriptions; the particular application and legal circumstances matter.

What should a designer do if a component seems novel?

  1. Describe the specific subject: Identify the actual functional mechanism or the article design. “A new game” or “a clever way to play” is not a precise patent claim.
  2. Consider prior art and eligibility: Determine what already exists and whether the proposed subject can meet the applicable patent requirements. A claim that is merely an abstract idea is not enough.
  3. Get case-specific advice: Patentability and claim scope depend on details that a general article cannot assess. Consult qualified patent counsel before relying on an assumption of protection.

A patent is a right to exclude others from conduct covered by its claims; it is not a blanket permission for its owner to practice an invention. Existing rights may still matter. The USPTO’s trademark process page is not a patent source; patent-specific claims should be checked against USPTO patent guidance and case-specific advice.

When does protection begin, and how long can it last?

The starting point and duration depend on the type of right. Copyright generally begins when original expression is fixed; a trademark depends on source-identifying use and continued maintenance; a patent depends on an application, examination, and grant.

Right Starting point or maintenance General duration information
Copyright Generally begins on fixation of original expression; registration has separate benefits and a role in U.S.-work litigation. For many works created since 1978, author’s life plus 70 years. Joint works, work made for hire, and other situations have special rules.
Trademark Requires source-identifying use; federal maintenance filings begin between years five and six and recur later. Continued use and required maintenance are necessary; no single fixed end date applies if requirements continue to be met.
Utility patent Application and examination must lead to an eligible patent grant. Generally up to 20 years from the relevant nonprovisional filing date.
Design patent Application and examination must lead to a design patent grant. 15 years from grant, according to the USPTO.

The Copyright Office’s Copyright Basics (Circular 1) states that U.S. copyright exists automatically from the moment an original work is fixed. Automatic protection does not mean that registration is irrelevant: registration or refusal is generally needed before filing a federal infringement suit concerning a U.S. work, and timing can affect eligibility for statutory damages and attorneys’ fees.

Do I need to register before publishing a game?

Copyright is generally automatic on fixation, but registration can matter if a U.S. work is infringed and litigation is contemplated. Trademark and patent procedures are different: do not treat publication, a domain purchase, a prototype, or a print run as a substitute for determining what right applies and whether its requirements are met.

Copyright registration and published filing fees

The U.S. Copyright Office’s 2026 fee schedule lists $45 for a qualifying single-author electronic application and $65 for a standard electronic application. These are examples of filing fees, not a promise that a particular game or application qualifies for the lower fee. The Office’s general copyright FAQ explains registration and related matters. Check the current schedule and application requirements before filing.

Trademark application costs

The USPTO’s 2026 schedule lists a $350 electronic base application fee per class. That is not necessarily the total cost: the number of classes, eligibility, and additional fees can change the amount. A filing fee does not resolve whether a mark is protectable or conflicts with another mark.

Patent costs and process

No patent application total is established here. Patent search and examination fees, the work needed to describe claims or a design, and case-specific professional help can affect cost. Do not infer that paying to submit an application means the invention qualifies or will be granted.

What practical steps should a designer take?

Start by making an asset inventory. That makes it easier to ask a focused question about a rulebook, illustration, name, or component instead of assuming one form of protection covers everything.

  1. List each asset separately. Identify written rules, card text, illustrations, board graphics, the game name and logo, and any functional or ornamental physical component.
  2. Match the asset to the right category. Ask whether the concern is copied expression, a source-identifying mark, a functional invention, or an ornamental article design.
  3. Keep records of authorship and creation. Preserve dated drafts, source art, and agreements that establish who created or contributed material. Ownership and authorship can be fact-specific; the general distinctions here do not determine them.
  4. For a proposed name, search similar marks and relevant goods. Review actual use and distinctiveness rather than relying only on a domain or company-name reservation.
  5. For a potentially novel mechanism or design, identify it precisely. Consider prior art and obtain patent-specific advice before relying on a broad game concept.
  6. Check current government procedures and fees. Fee schedules and filing requirements can change, so confirm them with the Copyright Office or USPTO before submitting an application.

Building a physical prototype can help a designer communicate an idea, but making, buying, or printing one does not establish copyright, trademark, or patent rights. Likewise, using a print-on-demand service does not itself clear the game’s rights. A provider’s production or rights policy is not government approval and does not determine whether a particular game infringes another party’s rights.

Does changing the artwork make a game legally different?

Not necessarily. New artwork may change the visual expression, but it does not by itself answer questions about a similar game name, a potentially patented mechanism, permissions for other material, or other legal issues. Each right concerns a different asset, and a fact-specific review is needed to assess the relevant similarities and rights.

The reverse is also true: keeping the same general method of play does not automatically mean someone copied protected wording or art. The legal question depends on what material is used and which right is involved, rather than on a single broad label such as “the same game.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How should I choose which protection to investigate first?

Begin with the risk or asset that matters most to the project, not with the most familiar legal term. This decision guide can help frame the next question, though it cannot determine the outcome for a particular game.

  • Concerned about someone reproducing your prose or illustrations? Focus on copyright in the original fixed expression and identify exactly what was created.
  • Need a distinctive commercial identity for the game? Focus on trademark use, similar marks, strength, and related goods.
  • Believe a physical mechanism or article design is novel? Focus on the precise claimed invention or ornamental design, eligibility, and prior art with patent-specific advice.
  • Concerned about copying gameplay? Separate the method of play from the particular text and visuals. Copyright does not grant ownership of the underlying idea or method.

There is no general comparison that can establish whether a particular game is free to publish or whether its elements can be registered. A legal clearance or application decision depends on the actual assets, use, existing rights, and applicable requirements.

Frequently Asked Questions

Does owning a patent mean I am allowed to sell the patented game?

Not necessarily. A patent is a right to exclude others from conduct covered by its claims, not a blanket permission to practice the invention. Other rights or legal requirements may still affect a product.

Can I claim a game is protected just because I filed an application?

Filing is not the same as having an issued patent or an approved trademark registration, and a copyright filing does not certify that every submitted element qualifies. Describe the status accurately and avoid implying that an unexamined or unregistered item has been approved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a blank prototype kit or print-on-demand copy create legal protection?

No. A prototype or production run can make a game tangible, but it does not establish or clear intellectual-property rights. The rights question depends on the content, use, and applicable requirements.
