Usually, neither a city nor its residents can veto a video game merely because it depicts a real neighborhood. In the United States, a game may generally use real geography and an expressive fictional setting. Legal exposure depends on what was copied or claimed: a protected logo or building design, a person’s likeness, a third-party photograph or map, a contract, or an implication that a city or business sponsored the game. The answer can change by state, country, asset, and marketing context. This is general information, not legal advice.
The short answer: a real place is not automatically owned by anyone
A neighborhood’s existence, street layout, public geography, and general visual character are usually facts or ideas rather than a single copyrighted work. A municipality ordinarily has no blanket property right in the fact that a neighborhood exists, and a resident generally cannot stop a game from showing a public street simply because they live there.
That does not make every realistic depiction safe. The legal question is what the developer actually used and what the game communicates. Independently modeling a streetscape is different from scanning a photographer’s image. Naming a fictional shop is different from copying a real logo and presenting it as an official partner. Showing an anonymous row of houses is different from portraying an identifiable resident in a defamatory or commercially exploitative way.

Video games are expressive works protected by the First Amendment. In Brown v. Entertainment Merchants Association (2011), the Supreme Court stated that “video games qualify for First Amendment protection.” That protection is important, but it does not override generally applicable laws governing copyright, trademark confusion, publicity, privacy, defamation, or contracts.
What a city can—and cannot—usually claim
No general veto over a city’s name or geography
A city normally cannot prohibit a developer from setting a story in that city or depicting recognizable streets, transit patterns, parks, or neighborhoods. Copyright protects qualifying original expression, not locations, facts, or the idea of placing a fictional story in a real city. The federal rule concerning works of the United States Government also does not automatically answer ownership questions for every state or municipal asset.

Official marks and seals
A city may have enforceable rights in an official seal, logo, slogan, mascot, or other source-identifying mark. Trademark law can apply when use is likely to make players believe the city sponsored, licensed, approved, or produced the game. A mark used incidentally in an expressive setting is analyzed differently from a mark placed on the game’s cover, title, merchandise, or advertising as a badge of origin.
City-owned creative assets
Municipal ownership can matter when the game uses a particular asset rather than merely depicting a place. Examples include a city-owned promotional photograph, commissioned artwork, proprietary database, detailed map, or texture library. Ownership, employee-creation rules, contractor agreements, and licenses must be checked asset by asset. Public availability does not automatically mean unrestricted reuse.
Contracts, permits, and location agreements
A developer can create obligations through a filming permit, location release, data license, sponsorship agreement, or other contract. A city that granted access on conditions may have a contract claim even when copyright would not block an independently created depiction. The written terms, parties, territory, duration, and permitted media control the analysis.
False endorsement and damaging factual claims
Trademark law can reach false designation or descriptions suggesting an affiliation that does not exist. A game that merely uses a city as a setting is less likely to imply endorsement than one that displays an official seal beside “approved by the city,” or markets itself as an authorized municipal experience. Separately, a portrayal that makes provably false factual assertions about identifiable officials or institutions can raise defamation issues. A fictional setting, satire, or artistic transformation is not automatically immune, but courts distinguish expressive references from statements presented as factual reporting.
When residents have a claim
Living in the neighborhood is not enough
Residents generally do not control the depiction of a public road, block, or neighborhood. A person cannot usually demand removal simply because a game’s map resembles the view outside their home. The analysis changes when the game identifies or portrays that person.

Publicity and appropriation
State right-of-publicity laws can restrict commercial use of an identifiable person’s name, portrait, image, voice, or likeness. The statutes differ substantially: some cover only advertising and merchandising, while others reach broader commercial exploitation; exemptions for expressive works also vary. Recognizability, the statutory wording, and the legal character of the use matter. Litigation involving Lindsay Lohan and a video-game avatar illustrates that an avatar and a commercial game are not automatically sufficient to establish a statutory publicity claim.

Privacy theories
Possible privacy claims include intrusion into private space, disclosure of private facts, and related state-law theories. A publicly visible exterior is legally different from an interior obtained without permission, a private family detail, or a nonpublic image. Developers should identify whether a scene came from public observation, licensed reference material, user-submitted content, or an unauthorized entry or recording.
Defamation and false light
If a game communicates a provably false factual implication about an identifiable resident—such as depicting that person committing a specific crime—defamation or false-light claims may arise. Labels such as “fictional” help explain the work’s nature but do not automatically cure a realistic, identifiable false assertion. Context, audience interpretation, fault standards, and state law all matter.
Resident-supplied photographs and artwork
A resident’s photograph, mural, sculpture, interior design, or other original material may be separately protected. Permission to enter a location is not necessarily permission to copy the creator’s image or artwork. Obtain a license from the rights holder or create an independent replacement.

Buildings, architecture, maps, and textures
Do not use “public building” as a blanket rule
Copyright analysis turns on the particular work and the way it was reproduced. The U.S. Copyright Act contains specific provisions for architectural works and exclusive rights, so the safe formulation is not “all buildings are free” or “all buildings require permission.” Review the building, jurisdiction, date, ownership, and the source of the game asset.
Independent model versus copied reference
An artist who studies a public façade and builds new geometry and textures may present a different issue from a developer who imports a third party’s photograph, scan, photogrammetry data, map tile, or texture pack. Preserve source files and creation records so the team can show what it made, what it licensed, and what it did not copy.
Photographs, artwork, and fair use
Fair use is a fact-specific analysis, not a presumption. The purpose and character of the use, the nature of the source work, the amount taken, and the market effect all matter. A realistic game reference may support artistic relevance or commentary, but copying a high-resolution photograph or artwork wholesale can create substantial risk even when the subject is publicly visible. The Copyright Office’s Fair Use Index records varied outcomes involving photographs, graphics, news reporting, commentary, and video-game materials; no single “video-game rule” resolves every case.
Maps and databases
Street facts may be uncopyrightable, while a particular map’s selection, arrangement, labels, artwork, database structure, or licensed data may be protected or contractually restricted. Check the data provider’s license and avoid assuming that a publicly viewable map may be scraped, repackaged, or shipped with a game.

Real businesses, logos, and trade dress
A real business name, sign, logo, storefront, or distinctive trade dress should be reviewed individually. The key questions are whether the reference is expressive, whether it is artistically relevant, whether it functions as the game’s own branding, and whether players are likely to infer sponsorship or approval.

| Use | Why it matters | Risk questions |
|---|---|---|
| Business sign in a streetscape | May be an expressive reference that improves realism. | Is the sign independently recreated? Does the scene imply endorsement or make false factual claims? |
| Logo on the game box, title screen, or merchandise | Functions more like a source designation or marketing mark. | Would an ordinary buyer think the business sponsored or licensed the game? |
| Fictionalized name and altered logo | Can reduce confusion while preserving a recognizable setting. | Could the overall presentation still identify the real business and attach damaging implications? |
| Copied storefront photograph or artwork | May implicate the photographer’s or artist’s copyright. | Who created the source image, and what license covers reproduction? |
The Ninth Circuit’s Grand Theft Auto decision is a leading example of a court considering an expressive use of a potentially confusing business mark in a fictional city modeled on real urban areas. The decision illustrates that First Amendment balancing can protect artistic references, but it is not a universal license to use marks in advertising or to imply an affiliation.
Why a disclaimer helps—but does not solve everything
A notice stating that the game is fictional and unaffiliated can reduce player confusion about sponsorship or endorsement. It may be useful in the game, packaging, store listing, or credits when tailored to the actual risk. A disclaimer cannot transfer copyright, publicity, privacy, or contract rights; it cannot authorize a copied photograph, private interior, or restricted data set; and it cannot automatically defeat a defamation claim. Courts examine the entire presentation, including trailers, screenshots, metadata, influencer campaigns, and point-of-sale materials.
A practical clearance process before release
- Inventory every real-world reference. List city and neighborhood names, street layouts, landmarks, transit signs, businesses, logos, murals, public art, homes, interiors, and identifiable people. Include references appearing only in trailers, screenshots, downloadable content, menus, or promotional merchandise.
- Classify the source of each asset. Mark whether geometry, textures, photographs, maps, scans, databases, audio, or artwork were created in-house, licensed, supplied by a user, or obtained from a third party. Keep the license and attribution terms with the asset record.
- Separate setting from branding. Ask whether a mark is merely part of the fictional world or is being used to identify, sell, or endorse the game. Rework title-screen, box-art, and merchandise uses that could suggest official approval.
- Review people separately. For every recognizable resident, official, celebrity, or user-submitted likeness, analyze publicity, privacy, defamation, false-light, and consent issues under the applicable state law.
- Check buildings and private spaces. Confirm whether a depiction relies on copied photography, photogrammetry, artwork, a protected architectural design, or a private interior. Obtain permission or replace the source where rights are uncertain.
- Audit marketing and store materials. A legally defensible in-game reference can become riskier when a trailer highlights a real logo, claims city approval, or uses a person’s likeness to sell the game.
- Use a targeted disclaimer. State the fictional nature of the work and lack of affiliation where confusion is plausible, while recognizing that the notice is only one part of the analysis.
- Preserve evidence. Retain concept art, modeling files, dates, licenses, permissions, correspondence, and the editorial reason for each real-world reference. These records help explain independent creation and responsible review.
- Get local counsel for high-risk releases. Obtain jurisdiction-specific advice before launch when the game uses real residents, controversial allegations, official marks, private interiors, restricted data, or a real person as a central character.
Common scenarios and likely legal questions
A fictional city modeled on several real cities
Combining features from multiple places can support an expressive, fictional setting. Risk still turns on copied assets, recognizable marks, identifiable people, and marketing claims. Changing the name alone does not cure an unauthorized photograph or defamatory depiction.

A recognizable home on a public street
An exterior visible from a public place is generally less sensitive than a private interior. The developer should still avoid copying a third party’s photograph or implying that the occupants committed misconduct. A resident’s objection, by itself, is not a veto.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →A real restaurant shown as a crime scene
Use of the restaurant’s name or trade dress may be expressive, but a realistic scene that implies the actual restaurant sold contaminated food or facilitated a crime can create confusion, reputational, or defamation concerns. Fictionalization, altered branding, and a careful review of marketing may be appropriate.
An official city seal on a police vehicle
The seal may be protected, and its placement can imply authorization. Consider a fictional seal or a clearly transformed design unless permission and the intended affiliation are documented.
A likeness generated from a resident’s social-media photo
Public availability of a photo does not equal permission to use the person’s likeness commercially. Verify the photographer’s copyright and analyze publicity and privacy rights for the identifiable individual.
Jurisdiction and timing caveats
This framework is U.S.-focused. Publicity, privacy, defamation, architectural rights, government-asset ownership, and unfair-competition rules vary by state. Other countries may apply different moral-rights, personality-rights, trademark, privacy, or governmental rules. A release distributed worldwide should identify where claims could be brought and whether localization, asset changes, or regional restrictions are necessary.

Bottom line for developers and rights holders
A real neighborhood is usually available as an expressive setting, not as a blank check. Cities and residents gain stronger leverage when a game uses a specific protected asset, copies someone else’s creative work, violates a contract, identifies a person in a publicity or privacy context, makes a defamatory factual implication, or suggests sponsorship or approval. Build an asset inventory, document independent creation and licenses, scrutinize recognizable people and official marks, review every marketing channel, and obtain jurisdiction-specific counsel for the fact patterns that go beyond a generic streetscape.
