What Reverse Engineering Means for Open-Source Software Licenses and Copyright

Open source does not make reverse engineering unrestricted. This guide separates copyright, licensing, anti-circumvention, contract, and interoperability rules in the U.S., EU, and Germany.

Reverse engineering open-source software is not automatically legal or illegal. “Open source” describes a licensing model, not a surrender of copyright. Whether you may observe, disassemble, decompile, modify, or share software depends on the exact act, your authority to use the copy, the project’s license, technical access controls, your purpose, and the law governing the conduct.

Copyright generally protects a program’s expressive code, while ideas, principles, interfaces, and other functional facts may receive different treatment. A limited exception in United States law and specific interoperability rules in European Union and German law can permit some analysis, but none creates a worldwide right to copy code, bypass controls, or build a substantially similar product.

Reverse engineering is an umbrella term, not one legal act

People use “reverse engineering” to describe activities ranging from watching what a program does to translating machine code back into a higher-level representation. Those activities can trigger different legal rules.

Observation, testing, and tracing

Running software you are authorized to use, recording inputs and outputs, inspecting error messages, or testing how an interface behaves may reveal functional information. In the European Union, the software directive allows an entitled user to observe, study, or test a program’s functioning to determine the ideas and principles behind its elements while performing acts the user is entitled to perform. That permission does not automatically authorize copying protected expression or defeating an access restriction.

Disassembly and decompilation

Disassembly translates executable instructions into assembly language; decompilation attempts to reconstruct a higher-level form. These processes can involve reproducing or translating code, which is why statutes treat them more narrowly than ordinary testing. The portion examined, the reason for doing so, and what happens to the resulting information are central questions.

Copying, adapting, and distributing

Making a copy of source or object code, incorporating it into another game, distributing a modified build, or publishing reconstructed code can implicate the copyright owner’s exclusive rights even when the original project is publicly available. A license may grant some of those permissions, subject to conditions such as notices, source-availability obligations, or limits on downstream distribution. The repository’s visibility is not itself a license to perform every technical operation.

Open-source licensing does not remove copyright

Open-source programs remain copyright-protected works. An open-source license is the copyright holder’s permission to perform specified acts under stated conditions. The Open Source Definition describes criteria for licenses that qualify as open source, but the actual license attached to a project and the governing law determine what you may do in a particular case.

Read the complete license, notices, contribution terms, and any separate terms of service or developer agreement. A license can authorize modification and redistribution while saying nothing specific about bypassing a technological measure. It can also impose obligations on your distribution of a derivative or combined work. Contract terms may matter independently of copyright exceptions.

The key copyright distinction is between expression and underlying ideas. Council Directive 91/250/EEC states: “Ideas and principles which underlie any element of a computer program, including those which underlie its interfaces, are not protected by copyright under this Directive.” Learning how a protocol works is therefore a different question from copying the code that implements it. The method used to learn the information can still be restricted by anti-circumvention, contract, computer-access, privacy, or other rules.

The legal questions you must separate

A reliable analysis keeps several issues distinct instead of asking only whether reverse engineering is “allowed.”

  • Authority to access: Did you lawfully obtain the copy and have permission to run or inspect it?
  • Nature of the act: Were you observing behavior, reproducing code, translating code, adapting it, or distributing it?
  • Purpose: Is the work for interoperability, testing, error correction, security research, education, or another objective?
  • Necessity: Was the information already readily available, and was reverse engineering indispensable to obtain it?
  • Scope: Did you examine only the parts needed for the stated purpose?
  • Downstream use: Will you keep the information for compatibility, disclose it only as needed, or use it in a competing program?
  • Technical controls and agreements: Did you circumvent an access control, breach a contract, or access a system beyond authorization?

Passing one test does not answer the others. An act might qualify for a copyright exception yet still violate a contract, privacy law, computer-access statute, or a rule against circumventing a technological measure.

United States: a narrow interoperability exception

Section 1201 of Title 17 of the United States Code generally prohibits circumventing a technological measure that effectively controls access to a copyrighted work. Subsection 1201(f) creates a limited interoperability route. The current U.S. Code page states that the text is effective through Public Law 119-120, enacted October 7, 2026.

Conditions in §1201(f)

The person must have lawfully obtained the right to use a copy of the computer program. Circumvention must be solely for identifying and analyzing elements of the program that are necessary to achieve interoperability with an independently created program. Those elements must not have been previously readily available, and the acts must go no further than necessary and must not infringe copyright.

The statute defines interoperability as “the ability of computer programs to exchange information, and of such programs mutually to use the information which has been exchanged.” It also permits developing or employing technological means needed for qualifying analysis or interoperability. Information and those means may be shared only for the interoperability purpose and only to the extent that sharing neither infringes copyright nor violates other applicable law.

What the exception does not do

Section 1201(f) is not a general permission to bypass a game’s protection, copy its assets, extract source code, or produce a substantially similar competing game. It does not erase copyright infringement, and it does not override contract, privacy, computer-access, or other legal restrictions. Section 1201 itself preserves copyright rights, remedies, limitations, and defenses, including fair use; anti-circumvention and infringement must therefore be analyzed separately.

U.S. decision checklist

  1. Confirm that you legally acquired the right to use the specific copy.
  2. Identify the independently created program that must interoperate and the information it needs.
  3. Document why the information was not already readily available.
  4. Limit analysis and any circumvention to the necessary portions and purpose.
  5. Keep the resulting information and tools within the interoperability purpose, and review other applicable law before sharing.

European Union: observation and decompilation have different rules

Council Directive 91/250/EEC protects computer-program expression as a literary work while excluding ideas and principles underlying program elements, including interfaces. It permits an entitled user to observe, study, or test functioning to determine those ideas and principles while carrying out acts the user is entitled to perform.

Article 6 decompilation conditions

Article 6 permits reproduction of code and translation of its form without the rightsholder’s authorization only when all of the directive’s conditions are met:

  • The acts are indispensable to obtain information necessary for the interoperability of an independently created program.
  • The acts are performed by an authorized user, or by someone acting on that user’s behalf.
  • The necessary information was not previously readily available.
  • The work is confined to the parts of the original program that are necessary.

The information obtained may not be used for purposes other than achieving interoperability, given to others except when necessary for that purpose, or used to develop, produce, or market a program substantially similar in its expression. It also may not be used for any other act that infringes copyright.

Article 9 says the directive does not displace other legal rules, including contract law. Provisions contrary to the Article 6 decompilation conditions are null and void, but that does not turn every decompilation project into a lawful one; the factual conditions still have to be satisfied.

Why the directive’s date matters

Directive 91/250/EEC is an older instrument. It should not be presented as the latest consolidated statement of all EU software law. Member-state legislation, later directives, court decisions, contractual terms, and national procedures can affect the result. For a live project, check the current law in the country whose courts and rules would govern.

Germany: §69e of the Copyright Act

Germany’s official English text of Copyright Act §69e contains a national decompilation rule with conditions that closely track the EU framework. An authorized user may reproduce or translate code only to the extent necessary to obtain information required for interoperability of an independently created program, when the information was not readily available by other means and the work is limited to necessary parts.

The provision restricts use and disclosure of the information, protects the rightsholder’s legitimate interests, and prevents use to create a program substantially similar in expression or otherwise infringe copyright. It expressly preserves other legal rules, including agreements based on obligations law. A German license or contract can therefore create issues even when the statutory interoperability conditions appear satisfied.

A practical process before examining a game or tool

  1. Identify the copy and your authority. Record how you obtained the executable, whether the license permits your intended use, and whether you are acting for an authorized user.
  2. Write a narrow purpose statement. Describe the compatibility problem, error, or interface you need to understand. “Learn how the game works” is broader and less defensible than “identify the packet fields required for an independently written client.”
  3. Check available information first. Review documentation, published interface specifications, developer disclosures, and other lawful sources. Preserve what you checked and why it was insufficient.
  4. Choose the least intrusive method. Start with ordinary execution and testing. If disassembly or decompilation is necessary, define the modules and functions involved before beginning.
  5. Separate facts from code. Record protocol behavior, data formats, and interface requirements without copying implementation text, creative assets, or unnecessary portions of the program.
  6. Control the output. Restrict notes, tools, and disclosures to the stated purpose. Do not publish reconstructed code or use findings to make a substantially similar game.
  7. Review non-copyright constraints. Check anti-circumvention rules, terms of service, confidentiality, privacy, computer-access law, export controls, and the law of every place where the work and distribution occur.
  8. Obtain jurisdiction-specific advice for high-risk work. A commercial compatibility product, public release, security disclosure, or work involving a protected online service warrants advice based on the current law and exact documents.

Common mistakes and safer alternatives

“The repository is public, so anything is permitted”

Public visibility does not grant permission to bypass a technical control or redistribute code outside the license. Use the license and documented access rights as the starting point.

“Interoperability means cloning the original”

Interoperability concerns exchanging and mutually using information. It does not authorize copying expressive implementation, artwork, text, or a game’s overall expression.

“A copyright exception overrides the terms of service”

Copyright exceptions and contractual promises are separate. A platform agreement may restrict conduct that a copyright rule alone would not prohibit, subject to the governing law’s treatment of those terms.

“Publishing every technical detail is harmless”

Disclosure can exceed what is necessary for compatibility and may expose security, privacy, or confidential information. Share only what the applicable rule and purpose require.

The Top System case should not be treated as a blanket right

The Court of Justice of the European Union’s Top System judgment, Case C-13/20, dated 6 October 2021, arose in an error-correction dispute involving the software directive. The decision is relevant to how the directive can apply outside a simplistic reading of Article 6, but it does not establish an unrestricted right to decompile any program. Anyone relying on the case should read the operative judgment and current national law, then match the facts to the authorized-user, necessity, scope, and downstream-use requirements.

What a defensible project file should contain

  • The exact software version, license, notices, and contract terms.
  • The identity and authority of the user who obtained the copy.
  • A dated description of the interoperability or error being addressed.
  • Evidence that relevant information was not readily available elsewhere.
  • A record of the smallest portions examined and why each was necessary.
  • Separate storage for observations, copied code, and independently written implementation.
  • A disclosure plan limited to the lawful purpose, with review for privacy, security, and confidentiality.
  • A jurisdiction review covering where the analysis occurred, where servers and users are located, and where any resulting program will be distributed.

As of 13 October 2026, the safest general conclusion is conditional: authorized study and narrowly necessary interoperability work may have protection in specific legal systems, while copying, circumvention, disclosure, and commercial reuse can create separate liability. The exact license, access method, purpose, scope, and governing law decide the outcome.
