Stay calm, do not interfere, and put one manager in charge. Ask the lead officer for the warrant or other legal authority, call criminal-defense counsel, and avoid consenting to searches or interviews beyond what the law requires. Tell staff not to hide, move, delete, or alter anything. Preserve CCTV, access logs, point-of-sale records, cloud accounts, chat, tournament files, and device details, and request an inventory of anything taken. The correct response depends on your country or state, the issuing agency, the warrant’s wording, and whether wagering or regulated gaming was involved.
The first 10 minutes: a safe, lawful response
A raid is stressful, but hurried decisions can create obstruction, evidence-destruction, or consent problems. Use this sequence while officers secure the premises:

- Keep everyone safe and hands-off. Follow lawful directions, keep staff and players away from restricted areas, and never block a doorway, grab equipment, argue physically, or attempt to delay officers. American Bar Association business guidance says management must instruct employees “not to obstruct the search in any way.”
- Appoint one point of contact. The owner or a designated senior manager should greet the lead agent, record names, badge numbers, agencies, arrival time, and contact details, and maintain a written timeline. Everyone else should return to normal duties only when officers permit it.
- Ask what authority is being used. Politely ask whether officers have a search warrant, subpoena, consent, or are relying on an emergency exception. Request to see the warrant and any supporting papers. Do not sign a consent form, statement, receipt, or waiver before counsel reviews it.
- Call criminal-defense counsel immediately. Ask whether officers will wait for counsel, but do not assume they must. A request to wait is appropriate; physically delaying the search is not.
- Give a narrow, factual instruction to staff. Tell employees to follow safety directions, preserve all records, avoid substantive questioning unless they choose to answer, and never guess, lie, or destroy anything. Do not announce theories about why the raid occurred.
What a warrant does—and does not—authorize
In the United States, Federal Rule of Criminal Procedure 41 allows a warrant for evidence of a crime, contraband, fruits or instrumentalities of crime, property used in a crime, or a person to be arrested. A federal judge must find probable cause before issuing a federal warrant. State warrants follow the applicable state constitution and procedure, which can differ in important ways.

Read the document carefully with counsel. Note the issuing court, date, location, offense, listed rooms, categories of records, devices, and any limits on when or how the search may occur. A warrant for a server room and accounting records is not automatically authority to search every employee’s home, personal cloud account, or unrelated venue. A warrant also does not automatically permit officers to take items outside its description; exceptions can exist, but counsel should analyze them.

If officers appear to exceed the listed scope, do not touch or block them. State the concern once, ask that it be noted in the incident record, and write down what happened. A calm objection preserves the issue without creating an obstruction allegation. Never expand the search by volunteering passwords, opening additional rooms, or pointing out unrelated equipment.
Managing employees, players, and visitors
Employees who are questioned
A search warrant authorizes a search; it does not itself give agents a general right to interrogate every employee. American Bar Association guidance states that a warrant does not give agents the legal right to interrogate employees. A worker may ask, “Am I free to leave?” If the answer is yes, the worker may leave or decline substantive questions. If the answer is no, the worker should remain calm and request counsel.
Employees must not make false statements, conceal evidence, warn suspects to flee, or otherwise obstruct. “I do not want to answer questions without a lawyer” is different from lying. Management should not promise immunity, coach a story, or order staff to refuse lawful identification requests. Counsel can provide a consistent employee-rights briefing after the premises are secure.

Players, minors, and visitors
Ask officers how they want visitors handled and keep minors with their parents or designated guardians when possible. Do not search guests, take their phones, or copy their identification unless a lawful policy or officer direction requires it. Record who was present and when people were released, but avoid publishing names or accusations.
Protecting privileged and confidential material
Tell counsel immediately if the venue has attorney-client emails, legal advice, draft responses to regulators, or attorney work product among the files officers identify. Do not try to win a privilege dispute by physically withholding a laptop or grabbing a folder. Counsel can ask for a privilege review, a sealed submission, or another procedure recognized by the court.
Keep ordinary business confidentiality separate from legal privilege. Customer lists, sponsor contracts, payroll, and tournament rules may be sensitive, but sensitivity alone does not make them privileged. Labeling every file “confidential” does not prevent lawful seizure.

Digital evidence: PCs, servers, CCTV, and cloud accounts
Gaming venues can hold evidence across dozens of systems: gaming PCs, administrator laptops, network appliances, CCTV recorders, access-control panels, point-of-sale terminals, payment processors, tournament platforms, messaging tools, and cloud storage. Treat every system as potentially relevant and preserve it without changing its contents.

Do not close accounts, rotate encryption keys, or run deletion scripts after officers arrive.
- Preserve video and logs. Export or lock CCTV, door-access, POS, server, and security logs under counsel’s direction before automatic retention overwrites them. Keep the original files and document the export method, time zone, and person who handled each copy.
- Record device identity. Note make, model, serial number, asset tag, user, location, and whether a device was powered on. Photographing labels is safer than changing settings.
- Protect remote records. Ask counsel to issue preservation requests to hosting, email, chat, payment, and tournament providers and to suspend routine deletion. Under 18 U.S.C. § 2703(f), a governmental preservation request generally requires an electronic-communications or remote-computing provider to preserve records for 90 days, with one possible additional 90-day renewal. That preservation period does not determine whether a search or seizure was lawful and does not replace a forensic collection plan.
- Do not volunteer credentials. A password request, compelled access, and decryption order raise jurisdiction-specific issues. Refer every request to counsel and record exactly what was requested and provided.
The Department of Justice has discussed privacy expectations in business computers and cautioned that an employer’s consent does not automatically authorize government seizure of every employee’s data. Separate business and personal accounts, use documented access controls, and let counsel address mixed data rather than attempting an improvised deletion or segregation.
Documenting the search and getting back essential information
Assign a note-taker who does not interfere. Record the start and end time, rooms entered, equipment moved, statements about scope, requests made, and names of witnesses. If local law permits and it is safe, photograph or video the search from a reasonable distance. Audio recording can be restricted by state consent laws, so ask counsel before recording conversations.

Request a property inventory or receipt before officers leave. Compare it with your notes and photograph any document you receive. Ask whether officers can provide copies or forensic images of records needed to keep the venue operating, such as payroll, customer-contact information, event bookings, or non-evidentiary configuration files. Officers may decline or require a court order; the request should still be specific and documented.

When the raid ends: the next 24 hours
- Secure the venue. Check doors, alarms, network cabinets, and remaining equipment. Do not re-enter a sealed area until officers release it.
- Preserve everything that remains. Counsel should issue an investigation or litigation hold covering paper files, email, chat, CCTV, cloud data, social-media accounts, and tournament records. Suspend routine deletion and device recycling.
- Reconcile the inventory. Identify each item taken, its serial number, the officer or agency listed, and any copy or image supplied. Give the list to counsel, insurers, and the venue’s technical lead as appropriate.
- Notify selectively. Inform insurers, landlords, investors, tournament partners, or payment providers only after counsel considers policy, lease, confidentiality, and regulatory duties. Do not speculate about suspects or charges.
- Prepare a factual message. A short statement can say that authorities conducted a search, the venue is cooperating, and operations or event schedules will be updated when confirmed. Do not delete comments, posts, or chats because they are embarrassing; preserve them under the hold.
- Decide whether to reopen. Counsel should review any seizure that affects fire safety, data security, payroll, licensing, or customer privacy before reopening. If critical systems are gone, use documented replacement equipment and preserve the original configuration records.
Why esports and gaming venues can attract regulatory scrutiny
A raid may concern more than ordinary criminal evidence. Esports events can implicate contest, sweepstakes, anti-gambling, and sports-wagering rules. The legal analysis turns on the structure of the event, not its marketing label. Counsel should examine entry fees, prize funding, sponsor payments, betting integrations, age controls, payment flows, skill-versus-chance elements, and tournament terms.

A United States gambling operation generally must be in a state that permits the activity and must hold the required gaming license. Requirements vary by state and can apply to proprietors, service providers, and suppliers. For example, Ohio’s Casino Control Commission states that all sports-gaming proprietors, service providers, and suppliers must be licensed to operate in Ohio. A venue should not resume wagering-linked activity merely because the physical search is over.

Preparing a raid-response plan before anything happens
A written plan reduces confusion without encouraging staff to resist. Keep a printed and offline copy because network access may be unavailable during a search.
- Name primary and backup managers, criminal-defense counsel, privacy counsel, and a digital-forensics contact with 24/7 numbers.
- Maintain an up-to-date asset register covering PCs, servers, CCTV, routers, POS terminals, storage locations, serial numbers, and cloud administrators.
- Document retention periods and disable automatic deletion for security video, access logs, tournament records, payments, and chat when an incident hold is issued.
- Train staff on a simple script: be respectful, do not obstruct, do not consent on the company’s behalf, do not guess, and preserve evidence.
- Separate personal and company accounts, limit administrator privileges, and keep recovery information in a secure, documented location.
- Review licenses, age controls, wagering integrations, prize terms, and sponsor arrangements with counsel before each regulated event.
Choosing outside response help
If the venue hires a law firm, forensic examiner, or incident-response provider, compare capabilities rather than accepting the first available contact. Ask about:
- Criminal-search, seizure, and regulatory experience in the venue’s state or country.
- Ability to preserve cloud records, CCTV, POS systems, gaming platforms, and chat without altering originals.
- Privilege handling, chain-of-custody forms, forensic imaging, and secure evidence storage.
- Knowledge of esports, contest, wagering, licensing, age-verification, and payment rules.
- Response time, overnight and weekend availability, and who will be physically present.
- Fees, insurance, conflicts checks, subcontractors, and limits on emergency work.
Jurisdiction matters
This guidance is operational, not a jurisdiction-specific legal opinion. State and national rules can change the result, especially where officers are state or federal, where a warrant was issued, where data is stored, or where wagering is involved. Before consenting to any additional search, making public statements, or reopening regulated activities, have local counsel review the warrant, inventory, preservation requests, and applicable licensing rules.
