In November 2015, Major League Baseball objected to a free Fallout 4 mod that put David Ortiz’s name and Red Sox marks on an in-game baseball uniform. MLB said it considered the use of its marks an infringement and planned to enforce its rights. Within days, GameSpot reported that the download link was gone—but the available reporting does not establish why it disappeared or document a court ruling.
What the David Ortiz mod changed in Fallout 4
Fallout 4 takes place in a post-apocalyptic version of Boston, where Fenway Park appears as the settlement Diamond City. Players could buy a plain baseball uniform in the game. Texas-based creator Richie Branson modified the game’s texture files to add a Red Sox logo, Ortiz’s name and number, and a red “B” on the helmet, according to The Boston Globe’s November 12, 2015 report.

Branson said he wanted the mod to make the Boston setting feel more authentic. He told the Globe, “Basically, I think it was the only thing missing from the game. You’ve got Fenway Park, the Green Monster, and all of Boston, but there weren’t any Red Sox jerseys.”
Why MLB objected
MLB’s concern, as stated publicly, was the use of marks associated with the league and the Red Sox. A league spokesman told the Globe by email: “The use of these marks is an infringement of our rights. We plan to enforce those rights.” That is MLB’s position, not a court’s finding.

Branson emphasized that he was not selling the uniform: “I’m not trying to sell this counterfeit Red Sox jersey. I’m putting a free Red Sox graphic into a game that already insinuates the Red Sox are in the game, at Fenway Park.” The mod was described as free and non-commercial in contemporaneous coverage. That fact explains the creator’s response, but does not by itself establish whether using the marks was lawful.
Did MLB take the mod down?
GameSpot reported on November 13, 2015, that the download link was gone. It also reported that the video description had been updated with this disclaimer: “This mod was not created in affiliation with MLB, The Red Sox, or David Ortiz.” See GameSpot’s November 13 report.

This confirms that the linked download was unavailable at the time GameSpot checked. The cited reports do not establish that MLB issued a formal takedown notice, explain the precise reason the link disappeared, or show whether the mod was later reposted elsewhere.

It does not document a lawsuit or judicial ruling resolving the dispute, so MLB’s infringement statement should not be presented as an adjudicated legal conclusion. The Globe described Fallout 4 as released for PlayStation 4, Xbox One, and Microsoft Windows. That is historical launch-platform reporting, not confirmation of current editions, storefront availability, or stock. The Ortiz mod was a separate fan-made download, not content established as part of the base game.
