The notice attributed the action to a law-enforcement operation involving the FBI and Dutch FIOD—not to Nintendo directly. It cited a warrant under 18 U.S.C. 2323 issued by the U.S. District Court for the Northern District of Georgia.
What happened to Nsw2u and Nswdl?
Notebookcheck reported that both sites were offline and displaying FBI seizure messages. Its account described the sites as linking to Switch ROMs, which means a site could direct visitors to files without necessarily hosting those files itself. The report does not establish the operators’ identities or give a full account of the investigation.
The notice quoted in the report said the domains were seized “in accordance with a seizure warrant issued pursuant to 18 U.S.C. 2323 issued by the United States District Court for the Northern District of Georgia as part of a law enforcement operation and action by the Federal Bureau of Investigation”. Notebookcheck also reported Dutch FIOD involvement. The quoted wording comes from the notice as reproduced by Notebookcheck; it is not a separately examined copy of the warrant. Notebookcheck’s account of the seizure notice
This supports describing the event as a government domain seizure attributed to law enforcement. It does not establish that Nintendo carried out the seizure. The consulted account also does not confirm the domains’ current status.

How the seizure fits Nintendo’s anti-piracy policy
Nintendo’s Intellectual Property & Piracy FAQ says the company seeks to reduce online distribution of unauthorized game copies, circumvention devices or software, and counterfeit products. It describes four parts of its approach:
- Legal enforcement
- Consumer awareness
- Technology
- Seeking improved intellectual-property legislation
That policy helps explain Nintendo’s broader anti-piracy efforts, but it is separate from the specific government action against these domains. Nintendo says authentic digital games are available through Nintendo eShop and the Nintendo website. It also states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s position in its FAQ, not a complete analysis of how every jurisdiction’s law applies. In a different case, Nintendo of America Inc. v. Williams, a U.S. District Court for the Western District of Washington entered a September 23, 2026 order awarding $4.5 million in statutory damages and permanently enjoining Williams from continuing online shops that offered pirated Switch games. That civil judgment involved a different operator and should not be confused with the warrant-based seizure of Nsw2u and Nswdl domains. The 2026 judgment in Nintendo of America Inc. v. Williams
