On May 19, 2025, SAG-AFTRA said it had filed an unfair-labor-practice charge against Llama Productions, Fortnite’s signatory company. The union alleged that AI-generated voices replaced bargaining-unit work without notice or an opportunity to bargain. That was an allegation in a labor filing—not a finding that the company violated labor law.
What was the dispute about?
SAG-AFTRA’s objection, as it described it, was about bargaining over work and employment terms—not opposition to performers or estates controlling digital replicas. In its May 19 statement, the union said it welcomed new technology and supported members’ and estates’ rights to control replicas. It argued that employers still had to bargain over using AI voices in ways that replace union members’ work, including work by performers who had matched Darth Vader’s rhythm and tone in video games.
The Form 501 charge alleges that Llama Productions made unilateral changes by using AI-generated voices to replace bargaining-unit work on Fortnite without giving the union notice or a chance to bargain in good faith. The charge records SAG-AFTRA’s claim; it is not an NLRB decision.
What did Fortnite’s AI Darth Vader do?
Fortnite introduced the conversational Darth Vader feature on May 16, 2025, according to Ars Technica’s contemporaneous report. The report said Google’s Gemini 2.0 generated dialogue, while ElevenLabs’ Flash v2.5 produced real-time speech based on James Earl Jones’s voice. Ars also reported that players briefly manipulated the feature into producing profanity and inappropriate language, after which Epic implemented a fix. That account concerns the feature at launch; it does not establish its current behavior.

Did James Earl Jones’s estate authorize the voice?
Ars Technica reported that Jones’s estate had authorized a synthesized version of his voice for the Fortnite character. That reported permission answers a different question from SAG-AFTRA’s charge. Estate authorization concerns the use of Jones’s digital replica; the union alleged that Llama Productions had a separate obligation to notify and bargain over work performed by bargaining-unit members. One does not, by itself, resolve the other.
What happened to the video-game strike and the AI rules?
SAG-AFTRA announced on June 11, 2025, that the video-game strike was suspended pending ratification. On July 9, the union said members approved the 2025 Interactive Media Agreement by 95.04% to 4.96%, concluding the strike. Its ratification announcement described new AI protections that include consent and disclosure requirements for digital-replica use, as well as a performer’s ability to suspend consent to generate new material during a strike.

The union’s agreement FAQ explains that the contract covers vocal digital replicas in both in-game and cinematic material and describes provisions for usage reports, information requests, claims, and arbitration. The FAQ is the union’s explanation of the agreement; the contract text governs detailed interpretation.

The July agreement ended the broader video-game strike, but that fact alone does not establish what happened to the May charge against Llama Productions. The cited public materials do not verify a disposition of that individual charge, so it should not be described as decided, dismissed, settled, withdrawn, or moot on this basis.
