Short answer: A Nintendo Switch game downloaded from Nintendo eShop or Nintendo’s website is different from a game file downloaded from an unauthorized source. Nintendo identifies MIG Switch/MIG Flash as circumvention devices designed to bypass Switch security and enable unauthorized copies. Whether a particular use is legal depends on jurisdiction and facts; in the United States, owning a cartridge does not by itself establish a general right to bypass access controls or use a MIG Switch.
What counts as a “downloaded Nintendo Switch game”?
The source of the file matters. Nintendo says genuine games are available through its authorized eShop and website. A game obtained through those channels is not the same as a copy downloaded from an unauthorized source, which may infringe copyright.
- Authorized download: A genuine game obtained through Nintendo eShop or Nintendo’s website.
- Unauthorized download: A game file obtained from a source that does not have the right to distribute it.
Nintendo describes piracy as unlawful and identifies unauthorized copies as the kind of content its anti-piracy measures address. Nintendo’s Intellectual Property & Piracy FAQ explains its position.
What is Nintendo’s position on MIG Switch?
Nintendo’s support FAQ lists “Piracy cartridges such as MIG Switch/MIG Flash, R4 Switch and others” as circumvention devices. Nintendo says they are designed to bypass Switch security measures and allow play of unauthorized copies. That is Nintendo’s characterization; it does not, by itself, decide the legal outcome under every country’s laws.

Nintendo also warns that using unauthorized devices may affect online play and that network updates may affect console operation. These are potential risks stated by Nintendo, not guaranteed outcomes for every user. Read Nintendo’s FAQ.
What does U.S. law say?
This section concerns U.S. law only and is general information, not individualized legal advice. The relevant issues can include copyright, anti-circumvention law, Nintendo’s contract terms, and account or service enforcement. Those are distinct questions, and a conclusion about one does not automatically answer the others.

Copying and circumvention are separate issues
Section 1201(a)(1)(A) of the U.S. Copyright Act says: “No person shall circumvent a technological measure that effectively controls access to a work protected under this title.” Section 1201(a)(2) also restricts trafficking in certain technologies, products, services, devices, or components primarily designed or marketed for circumvention, or with only limited commercially significant non-circumvention uses. The statute includes exceptions and does not eliminate copyright defenses or other limitations. Read 17 U.S.C. § 1201.
That means a personal copy, an unauthorized download, distribution of a copy, and bypassing an access control are not interchangeable legal questions. The fact that someone owns a physical cartridge does not automatically resolve whether making or using another copy is permitted, or whether bypassing a technical measure is lawful.

The video-game exemptions are narrow
Current 37 C.F.R. § 201.40 includes limited exemptions for lawfully acquired video games in specified circumstances, such as certain games affected by discontinued server authentication or no longer reasonably available. The permitted activity is restricted to defined purposes, including specified local gameplay or preservation by an eligible library, archive, or museum. It is not a general exemption for downloading commercial games or using a MIG Switch. Read 37 C.F.R. § 201.40.
Does owning the original cartridge make MIG use legal?
Not necessarily. Ownership may be relevant to a particular copyright question, but it does not itself establish a general U.S. exception to anti-circumvention rules. The method used to make a copy, whether a technical protection was bypassed, how the file is used, and whether it is shared or distributed can all matter. The available statutory exemptions are specific rather than a blanket personal-backup permission.

What Nintendo’s user agreement adds
Nintendo of America’s Switch User Agreement says: “The Software is licensed, not sold, to you solely for your personal, noncommercial use on the Console.” It separately restricts copying and circumvention unless applicable law permits them, and says content obtained through unauthorized devices or unauthorized modification may be removed. These are contractual terms between Nintendo and users, not a universal statement of criminal law. Contractual or service consequences can be different from whether conduct violates a statute, and Nintendo’s terms do not settle how another jurisdiction’s laws apply.

How to assess your situation
- Check the source: Was the game obtained from Nintendo or from an unauthorized distributor?
- Separate the acts: Consider downloading, copying, bypassing protection, using a device, and sharing a file as distinct conduct.
- Identify the jurisdiction: The U.S. statutes and regulations discussed here do not decide the law in other countries.
- Check the relevant terms: Nintendo’s agreement may affect access to its services or content independently of statutory liability.
- Get legal advice for a specific case: The details of how a copy was created and used can change the analysis.
